.shopping ruled confusingly similar to .shop

An International Centre for Dispute Resolution panelist has ruled that .shop and .shopping are too confusingly similar to coexist on the internet.
The panelist was Robert Nau, the same guy who ruled that .通販 and .shop are confusingly similar.
Again, the objector is .shop applicant Commercial Connect, which filed String Confusion Objections against almost every new gTLD application related to buying stuff online.
The defendant in this case was Donuts, via subsidiary Sea Tigers LLC.
Here’s the key part of the decision:

the concurrent use of “shopping”, the participle, and the root word “shop”, in gTLD strings will result in probable confusion by the average, reasonable Internet user, because the two strings have sufficient similarity in sound, meaning, look and feel. The average Internet user would not be able to differentiate between the two strings, and in the absence of some other external information (such as an index or guidebook) would have to guess which of the two strings contains the information the user is looking to view.
The adopters of the applicable standard of review for string confusion hypothetically could have allowed an unlimited number of top level domain names using the same root, and simply differentiate them by numbers, e.g., <.shop1>, <.shop2>, <.shop3>, etc., or other modifiers, including pluralization, or other similar variations of a root word, or other modifiers before or after the root word. While that might allow for increased competition, as argued by Applicant, it would only lead to a greater level of confusion and uncertainty among average, reasonable Internet users. Accordingly, the Applicant’s argument that the concurrent use of a root word and its participle version in a string increases competition is not persuasive in this context, and is rejected.

So far, Commercial Connect has lost 15 of the 21 SCOs it filed, against strings as weird as .supply and .shopyourway. Four cases remain open.
There are nine applicants for .shop, including Commercial Connect. Uniregistry has also applied for .shopping, but did not receive an objection.

Donuts’ first gTLD sunrise slated for October 29

Donuts has reportedly become the first new gTLD registry to announce its first sunrise periods.
According to BrandShelter, part of the KeyDrive registrar group, nine of Donuts gTLDs will enter sunrise on October 29.
The nine are: .camera, .clothing, .equipment, .guru, .holdings, .lighting, .singles, .ventures and .voyage.
The sunrise periods will last 60 days, BrandShelter said.
I’m seeking confirmation and additional information from Donuts and will provide an update later.
UPDATE: Donuts’ Jon Nevett, in the comments, states that the dates are “estimates”.

Donuts’ trademark block list goes live, pricing revealed

Donuts’ Domain Protected Marks List, which gives trademark owners the ability to defensively block their marks across the company’s whole portfolio of gTLDs, has gone live.
The service goes above and beyond what new gTLD registries are obliged to offer by ICANN.
As a “block” service, in which names will not resolve, it’s reminiscent of the Sunrise B service offered by ICM Registry at .xxx’s launch, which was praised and cursed in equal measure.
But with DPML, trademark owners also have the ability to block “trademark+keyword” names, for example, so Pepsi could block “drinkpepsi” or “pepsisucks”.
It’s not a wildcard, however. Companies would have to pay for each trademark+keyword string they wanted blocking.
DPML covers all of the gTLDs that Donuts plans to launch, which could be as many as 300. It currently has 28 registry agreements with ICANN and 272 applications remaining in various stages of evaluation.
Trademark owners will only be able to sign up to DPML if their marks are registered with the Trademark Clearinghouse under the “use” standard required to participate in Sunrise periods.
Donuts is also excluding an unspecified number of strings it regards as “premium”, so the owners of marks matching those strings will be out of luck, it seems.
Blocks will be available for a minimum of five years an maximum of 10 years. After expiration, they can be renewed with minimum terms of one year.
The company has not disclose its wholesale pricing, but registrars we’ve found listing the service on their web sites so far (101domain and EnCirca) price it between $2,895 and $2,995 for a five-year registration.
It looks pricey, but it’s likely to be extraordinarily good value compared to the alternative of Sunrise periods.
If Donuts winds up with 200 gTLDs in its portfolio, a $3,000 price tag ($600 per year) works out to a defensive registration cost of $3 per domain per gTLD per year.
If it winds up with all 300, the price would be $2.
That’s in line (if we’re assuming non-budget pricing comparisons and registrars’ DPML markup), with Donuts co-founder Richard Tindal’s statement earlier this year: that DPML would be 5% to 10% the cost of a regular registration.
Tindal also spoke then about a way for rival trademark owners to “unblock” matching names, so Apple the record company could unblock a DPML on apple.music obtained by Apple the computer company, for example.
Donuts is encouraging trademark owners to participate before its first gTLDs goes live, which it expects to happen later this year.

Nine more new gTLD contracts signed

ICANN signed nine more new gTLD Registry Agreements yesterday.
The contracts cover .kiwi, .futbol, .kitchen, .directory, .diamonds, .tips, .today, .enterprises, and .photography.
All but .kiwi, which will be run by Dot Kiwi Ltd, were Donuts’ applications.
ICANN now has Registry Agreements with registries to manage 45 new gTLDs.

Eight more new gTLD contracts signed, six by Donuts

ICANN has brought up its number of contracted new gTLDs to 32 with the signing of eight new Registry Agreements yesterday.
Six belong to Donuts:: .graphics, .technology, .reviews, .gallery, .guide and .construction.
Two IDN registries have also signed contracts: .我爱你 (Tycoon Treasure), which means “I love you” in Chinese, and .集团 (Eagle Horizon), which means “group” or “conglomerate” in Chinese.
The prioritization numbers for the 32 newly contracted application ranges from eight to 496. Almost all of the non-ASCII strings with contracts to date belong to Donuts.

Donuts signs three more new gTLD contracts

Donuts today signed Registry Agreements covering the new gTLDs .land, .plumbing and .contractors, according to ICANN.
The deals mean ICANN now has contracts covering 40 gTLDs, 22 of them as a result of the new gTLD program and 16 of which are to be managed by Donuts.
Like all the gTLDs Donuts applied for, they’re to be operated with an “open” registration policy.
It’s therefore ironic that the company should become the contracted registry for .plumbing and .contractors — both regulated industries where I come from — on the same day we find out that it can’t have .architect because architecture is a licensed profession.

First three Community Objections decided: DotGay and Google win but Donuts loses

The International Chamber of Commerce has delivered the first three Community Objection decisions in the new gTLD program, killing off one application and saving two others.
These are the results:
.gay
The objection filed by Metroplex Republicans of Dallas, a gay political organization, against DotGay LLC has failed.
The panelist, Bernhard Schlink, decided that Metrolplex lacked standing to file the objection, stating:

while the conservative segment, with which Metroplex claims association, is a segment of the clearly delineated gay community, it is not a clearly delineated community in and of itself. That some LGBTQ people hold conservative political views and vote for conservative candidates may bring them into a statistical category, but does not make them connect, gather, interact, or do anything else together that would constitute a community, or, that would make them publicly visible as one.

It was the only objection against this .gay application, meaning it can now proceed to later stages of the new gTLD process.
.fly
The objection was filed by FairSearch.org, a coalition of companies that campaigns against Google’s dominance of online markets, against Google’s .fly application.
The application was originally for a “closed generic” registry, but Google has since stated that it has changed its mind and run .fly with an open registration policy.
FairSearch lost the objection, despite ICC panelist George Bermann giving it the benefit of the doubt multiple times during his discussion on its standing to object.
Instead, Google prevailed due to FairSearch’s failure to demonstrate enough opposition to its application, with Bermann writing:

A showing of substantial opposition to an application is critical to a successful Objection. Such a showing is absent here.

He also decided that Google presented a better case when it came to arguing whether or not its .fly would be damaging to the community in question.
.architect
Finally, Donuts has lost its application for .architect, due to an objection by the International Union of Architects, which supports Starting Dot’s competing application for .archi.
Donuts had argued that UIA did not have standing to object because an “architect” does not always mean the kind of architect that designs buildings, which is the community the UIA represents. It could mean a software architect or landscape architects, for example.
But panelist Andreas Reiner found that even if the UIA represents a subset of the overall “architect” community, that subset was still substantial enough, still a community, and still represented by the string “architect”, so that it did have the standing to use the Community Objection.
It also did not matter that the UIA does not represent all the “structural architects” in the world, the panelist found. It represents enough of them that its opposition to .architect passes the “substantial” test.
He eventually took the word “architect” in its most common use — people who design buildings — in determining whether the UIA was closely associated with the community in question.
On the question of whether architects would be harmed by Donuts’ plan for .architect, the panelist noted that architects are always licensed for public safety reasons.
Here are some extracts from his decision, which seem important:

Beyond concerns of public safety, habitat for human beings is of essential importance in society, at the human-social level, at the economic level and at the environmental level

it would be compatible with the above references public interests linked to the work of architects and with the related consumer protection concerns, to allow the domain name “.architect” to be used by anyone other than “architects” who, by definition, need to be licensed

The use of the top-level domain “.architect” by non-licenced architects is in itself an abuse. This top-level domain refers to a regulated professional service. Therefore all safeguards must be adopted to prevent its use by a non-licensed person.

The top-level domain “.architect” raises the legitimate expectation that the related website is the webiste of a licensed architect (or a group of licenced architects). Correct information is essential to consumers visiting websites.

Basically, Reiner trashed Donuts long-standing argument in favor of blanket open registration policies.
He noted specifically that whether to allow a gTLD to proceed might be considered a free speech question, but said that free speech often has its limits, such as in cases of consumer protection.
Worryingly, one of the pieces of evidence that the panelist considered was the Governmental Advisory Committee’s Beijing communique, which contains the GAC’s formal advice against over 500 applications.

Donuts signs 12 more new gTLD registry contracts

Donuts today announced that it has signed 12 more new gTLD Registry Agreements with ICANN.
The contracts, which have not yet been published, cover .bike, .camera, .clothing, .equipment, .estate, .guru, .holdings, .lighting, .singles, .ventures, .voyage and .企业, which is “.enterprise” in Chinese.
As of a week ago, the firm has also passed all of its Initial Evaluations, with no failures.
According to the DI PRO database, Donuts still has a total of 300 applications in play, of which 148 are contested.
Another 30 have objections, at least 103 have GAC Advice, and 96 are classified as “uncalculated risk”, all factors that could lead to delay and possibly rejection.
Today’s news mean ICANN has signed registry contracts with at least 16 new gTLDs.
It’s not much by the standards it had set itself — expecting to sign 20 a week by now — but it’s almost as many as it’s signed in the preceding 15 years.

Panel says .sport and .sports are confusingly similar

Olympics-backed new gTLD applicant SportAccord has won a String Confusion Objection against Donuts, with an arbitration panel finding that .sport and .sports are too similar to coexist.
It’s the second SCO case involving a plural to go against Donuts, after the shock .pet/.pets decision last week.
While the judgment is sure to fuel the debate about singular and plural gTLD coexistence, the strings in question in this case do have some unique characteristics.
As panelist M Scott Donahey noted, .sport is both singular and a collective noun, making it essentially a plural and synonymous with .sports.
The sentences “I like sports” and “I like sport” both make sense and mean the same thing. The same could not be said for, for example, “I like car” or “I like pet”.
Donahey was also persuaded by the argument that because “sport” is also a French word meaning the same thing, the fact that “sports” and “sport” are pronounced the same in French means the two strings confusingly similar aurally. He wrote:

The convergence of all these similarities, the fact that the words look very similar in English and sound the same in French, and that the words can be used interchangeably as nouns in English to indicate the panorama of sporting activities, and that the words are interchangeable when used as adjectives in English, all lead the Expert to conclude that it is probable that confusion will arise in the mind of the average, reasonable internet user.

The panelist had access to the rulings in the .pets v .pet case (cited by SportAccord) and the .car v cars case (which went the other way and was cited by Donuts).
Donahey’s ruling is notable also because of what he explicitly declined to consider, namely: the possible harms that could be created by string confusion. He wrote:

Objector’s many references to possible fraud, deceit, cybersquatting or other types of abuse through the use of the gTLD proposed by Applicant are in the nature of a legal rights objection, and mere speculation, and are unworthy of any consideration by an Expert in a string confusion analysis.

In other words, he focused just on the visual, aural and semantic similarity of the two strings. It’s going to be hard for anyone to argue that he overstepped the bounds of an SCO, which has happened following other decisions.
All in all it seems like a pretty sensible decision (pdf). It’s hard to fault Donahey’s logic.
(As an aside, I’ve started to notice that the SCO decisions with the soundest reasoning seem to be coming from panelists, such as Donahey, with extensive experience adjudicating UDRP complaints).
If the ruling stands — that is, if ICANN does not reopen the plurals/singulars policy debate — Donuts’ application for .sports will be forced into a contention set with the two applications for .sport.

Google beats Donuts in objection — .pet and .pets ARE confusingly similar

Google has won a String Confusion Objection against rival new gTLD applicant Donuts, potentially forcing .pet and .pets into the same contention set.
The shock ruling by International Centre for Dispute Resolution panelist Richard Page goes against previous decisions finding singulars and plurals not confusingly similar.
In the 11-page decision, Page said he decided to not consider the reams of UDRP precedent or US trademark law submitted by the two companies, and seems to have come to his opinion based on a few simple facts:

Objector has come forward with the following evidence for visual, aural and meaning similarity. Visually, the words are identical but for the mere addition of the letter “s”. Aurally, the word “pets” is essentially phonetically equivalent to the word “pet”. The term “pet” is pronounced as it is spelled, “pet”. The term “pets” is likewise pronounced as “pets” in essentially a phonetically equivalent fashion. The terms each have only one syllable, and they have the same stress pattern, with primary accent on the initial “pe” portion of the words. In commercial meaning, the terms show no material difference. As English nouns, “pets” is the pluralization of “pet”.
The visual similarity and algorithmic score are high, the aural similarity is high, the meaning similarity is high. Objector has met its burden of proof. The cumulative impact of these factors is such that the Expert determines that the delegation of <.pet> gTLD and the <.pets> gTLD into the root zone will cause a probability of confusion.

Page did take into account the similarity score provided by the Sword algorithm — for .pet and .pets it’s actually a fairly weak 72% — in his thinking on visual similarity.
But he specifically rejected Donuts’ defense that co-existence of plurals at the second level was proof that plural/singular gTLDs could also co-exist at the top-level, saying:

The rapid historical development of the Internet and the proliferation of domain names over the past two decades has taken place without the application of the string confusion standard now established for gTLDs. Therefore, the Expert has not considered the current coexistence of pluralized second-level TLDs or similarities between country code TLDs and existing gTLDs in the application of the string confusion standard in this proceeding.

Can: open. Worms: everywhere.
The decision stands in stark contrast to the decision (pdf) of Bruce Belding in the .hotel v .hotels case, in which it was found that the two strings were “sufficiently visually and audibly different”.
Likewise, the panelist in .car v .cars (pdf) found that Google had not met the high evidential bar to proving the “probability” rather than mere “possibility” of confusion.
One has to assume that the evidence Google submitted in .car is fairly similar to the evidence it submitted in .pets.
Are String Confusion Objections just a crap shoot, the outcome depending on which panelist you get? It’s probably too early to say for sure, but it’s looking like a possibility.
The big test will come with the next .pets decision. Afilias, the other .pet applicant, has also filed an SCO against Donuts over its .pets bid.
What if the panel in the Afilias case goes the other way? Will Donuts be in a contention set with Google and Afilias or won’t it?
I asked Akram Atallah, president of ICANN’s Generic Domains Division, about this yesterday and he said that ICANN basically doesn’t know, and that it might have to refer back to the community for advice.
