Is the Trump administration really trying to reverse the IANA transition?

Questions have been raised about the US government’s commitment to an independent ICANN, following the release of letters sent by two top Trump appointees.
In the letters, new NTIA head David Redl and Secretary of Commerce Wilbur Ross expressed an interest in looking at ways to “unwind” the IANA transition, which in 2016 severed the formal ties between ICANN and the US in DNS root zone management.
Responding to questions from senators during his lengthy confirmation process, now National Telecommunications and Information Administration assistant secretary Redl wrote:

I am not aware of any specific proposals to reverse the IANA transition, but I am interested in exploring ways to achieve this goal. To that end, if I am confirmed I will recommend to Secretary Ross that we begin the process by convening a panel of experts to investigate options for unwinding the transition.

The letters were first obtained by Politico under the Freedom of Information Act. We’re publishing them here (pdf).
They were sent last August, when Redl’s confirmation to the NTIA role was being held up by Senator Ted Cruz, who vehemently opposed the transition because he said he thought it would give more power over online speech to the likes of Russia and China.
He was confirmed in November.
The question is whether Redl was serious about unwinding the transition, or whether he was just bullshitting Cruz in order to remove a roadblock to his confirmation.
Technically, he only promised to “recommend” convening a panel of experts to his boss, Ross.
NTIA declined to comment last week when DI asked whether the department still supports the IANA transition, whether any efforts are underway to unwind it, and whether the panel of experts has already been convened.
Redl’s statements on ICANN since his confirmation have been more or less consistent with his Obama-era predecessor, Larry Strickling, in terms of expressing support for multi-stakeholder models, but with perhaps some causes for concern.
During his first public speech, delivered at the CES show in Las Vegas earlier this month, Redl expressed support for multi-stakeholder internet governance amid pushes for more multi-lateral control within venues such as the International Telecommunications Union.
However, he added:

I’ll also focus on being a strong advocate for U.S. interests within ICANN. We need to ensure transparency and accountability in ICANN’s work. And in light of the implementation of the European General Data Privacy Regulation, or GDPR, we need to preserve lawful access to WHOIS data, which is a vital tool for the public.
In the coming weeks, I’ll be seeking out the views of stakeholders to understand how else NTIA can best serve American interests in these global Internet fora.

Could this be an allusion to the “panel of experts”? It’s unclear at this stage.
One of Redl’s first moves as NTIA chief was to slam ICANN for its lack of accountability concerning the shutdown of a review working group, but that was hardly a controversial point of view.
And in a letter to Senator Brian Schatz, the Democrat ranking member of the Senate Commerce Subcommittee on Communications, Technology, Innovation, and the Internet, sent earlier this month, Redl expressed support for the multi-stakeholder model and wrote:

NTIA will be a strong advocate for US interests with the Governmental Advisory Committee of the Internet Cooperation [sic] for Assigned Names and Numbers (ICANN) in the existing post-transition IANA phase. NTIA will also monitor the [IANA operator] Public Technical Identifiers (PTI) and take action as necessary to ensure the security and stability of the DNS root.

That certainly suggests NTIA is happy to work in the new paradigm, while the promise to “take action as necessary” against PTI may raise eyebrows.
While a lot of this may seem ambiguous, my hunch is that there’s not really much appetite to reverse the IANA transition. Apart from appeasing Cruz’s demons, what could possibly be gained?
Ross, quizzed by Cruz at his own confirmation hearing a year ago, seemed reluctant to commit to such a move.

Trump nominee open to retaking ICANN oversight role

The incoming head of the US Department of Commerce has indicated that it is unlikely he’ll try to reestablish the US government’s unique oversight of ICANN, at least in the short term.
But at his confirmation hearing in Congress yesterday, Trump nominee for secretary of commerce Wilbur Ross said he’d be open to ideas about how the US could increase its power over ICANN.
He was responding to a question from Ted Cruz, the Texas senator who made halting the IANA transition one of his key concerns last year.
Cruz, framing the question in such a way as to suggest ICANN is now in the hands of an intergovernmental consortium (which it is not) asked Ross whether he was committed to preventing censorious regimes using ICANN to hinder Americans’ freedom of speech.

Ross replied:

As such a big market and really as the inventors of the Internet, I’m a little surprised that we seem to be essentially voiceless in the governance of that activity. That strikes me as an intellectually incorrect solution. But I’m not aware of what it is that we actually can do right now to deal with that. If it exists, if some realistic alternative comes up, I’d be very interested.

His response also mischaracterizes the power balance post-transition.
The US is not “essentially voiceless”. Rather, it has the same voice as every other government as a member of the Governmental Advisory Committee.
Its role is arguably still a lot more powerful than other nations, given that ICANN is now bylaws-bound to remain headquartered in California and under US jurisdiction.
As head of Commerce, Ross will have authority over the National Telecommunications and Information Administration, the agency most directly responsible for dealing with ICANN and domain name issues in general.
NTIA itself will to the best of my knowledge still be headed by assistant secretary Larry Strickling, who handled the IANA transition from the US government side. (UPDATE: this may not be correct)
Ross, 79, is a billionaire investor who made most of his estimated $2.5 billion fortune restructuring bankrupt companies in the coal and steel industries.

Cruz keeps up pressure on ICANN brass

US presidential wannabe Sen. Ted Cruz has sent ICANN’s chair another nasty letter, demanding to know why he hasn’t yet responded to a laundry list of questions about former CEO Fadi Chehade’s relationship with the Chinese government.
The letter, also signed by fellow Republican senators Mike Lee and James Lankford, expresses “dismay” over the lack of response from Steve Crocker.
Cruz et al have been posing awkward questions to ICANN’s top brass since it emerged in December that Chehade had taken an unpaid position on an internet governance advisory committee run by China.
The senators say they’re worried that the US relinquishing its oversight of the IANA functions will give governments with poor freedom of expression records too much control over the internet.
A more likely explanation is that the IANA transition is an Obama initiative, and if Obama single-handedly saved a bunch of kids from a burning orphanage Cruz & Co would blame him for contributing to over-population.
That’s more or less the sentiment Chehade expressed at ICANN 55 last month, when he said:

And you know that this [Cruz] letter is not driven by anyone really worried about the transition. This is someone really worried about politics. So let’s not bring politics into the transition… Let’s resist bringing the politics of our lovely capital into this process… I think everyone knows this is political, even those in his own party… We will answer all these questions… And we will respond to the questions fully, to the Senators’ full satisfaction.

The new letter calls Chehade out for this statement, saying he “disparaged” what they call an “oversight request”.
An actual Congressional oversight hearing, focusing on the transition, a couple of weeks ago had absolutely no fireworks whatsoever.
It seems that the Republican-led committee actually responsible for internet matters, which does not include Cruz as a member, isn’t particularly upset about the IANA transition.
Nevertheless, the new Cruz letter re-poses a whole list of questions about Chehade’s involvement in China and Crocker and the ICANN board’s response to it.
The questions were originally asked March 3. ICANN had evidently said it would respond by March 18 but has not.
Cruz’s hand in the Republican primaries against front-runner Donald Trump has been strengthened in recent days, increasing the possibility that he could become US president next January.

China floats domain crackdown plans

The Chinese government is planning a crackdown on internet domains that could see mass censorship of non-Chinese names.
Draft rules floated for public comment this week are being widely reported as potentially blocking any domain that is not registered via a registry or registrar with a government license.
There are more than 50 provisions in the draft, but Article 37 is the one causing the most concern.
A translation published by Quartz yesterday has it reading like this:

Domain names engaging in network access within the borders shall have services provided by domestic domain name registration service bodies, and domestic domain name registration management bodies shall carry out operational management.
For domain names engaging in network access within the borders, but which are not managed by domestic domain name registration service bodies, Internet access service providers may not provide network access services.

At its worst, it suggests that every domain name not registered entirely through China-approved registries and registrars could be blocked from resolving in China.
You’d need a domain in .cn or a licensed gTLD, registered through a Chinese registrar, to access Chinese internet users, in other words.
But even Chinese locals who follow the issue closely are reportedly saying the regulations are vaguely worded, so it’s not clear exactly what would be blocked.

The rules also demand that domain name companies prevent domains carrying words deemed harmful from being registered.
There are additional controls on content — bans on porn, “rumor” and basically anything the Chinese government does not like — and registrant identity validation requirements.
The rules appear to be designed to replace the existing 2004 regulations that among other things force registrars and registries to obtain government licenses before the names they sell are allowed to resolve.
Those rules have led to several Western new gTLD registries, including Rightside, Famous Four Media and Minds + Machines, opening up corporate entities in China, in order to tap into the thriving market.
Local entities are of course subject to local laws — and ICANN contracts oblige them to abide by all applicable laws — which opens up the risk of Chinese regulations leaking out into the wider internet.
That almost happened with XYZ.com, which announced and then retracted (or clarified) an apparent plan to globally block domains deemed unsuitable by the Chinese censors.
It is inevitable that the proposals, which are open for public comment until April 25, will be used by US Congressional Republicans as a stick to beat ICANN and fight the imminent transition of IANA away from US government oversight.
High profile GOP politicians including presidential hopeful Ted Cruz have pointed to Chinese censorship as a risk of removing the USG from DNS root zone management.
But this isn’t really an ICANN problem as such. It’s a market forces problem.
Some new gTLD registries are seeing huge sales volume from Chinese registrants, who are trading many thousands of short, meaningless domains like baseball cards at the moment.
DI data shows that Chinese registrars accounted for 18.4 million gTLD domains in November 2015, up by 8.8 million domains in 12 months.
That number is likely to be several millions greater now, given the speculative activity of the last few months.
For registries, fully exploiting this market requires some sort of local presence, which in turn means exposing themselves to the already pretty bad Chinese censorship regime.
They’re going to have to be careful if they want to avoid China using the market to achieve the kind of back-door policy control it would never be able to obtain via ICANN.

More dirty tricks questions raised in .africa saga

DotConnectAfrica leaned on a former employee and used suspected astroturf in an unsuccessful attempt to have the Kenyan government support its .africa bid, newly published documents reveal.
Evidence to the .africa Independent Review Process case published for the first time by ICANN Monday night shows how DCA CEO Sophia Bekele attempted to secure Kenyan backing via a former chair of its own advisory board, who had gone on to be an adviser for Kenya on the ICANN Governmental Advisory Committee.
Emails suggest that this adviser tried to support DCA, against the wishes of his superiors in the Kenyan government, while they were distracted by a contested presidential election result.
They also show that Bekele on at least two occasions sent “news” stories published on web sites she has links to to another senior Kenyan official.
The full story is not yet on the public record — ICANN is still refusing to un-redact anything that the GAC has deemed confidential, including discussions on the GAC mailing list — but some interesting questions have nevertheless emerged.
Kenya divided
Three sets of emails were published.
One was between Bekele and a newly appointed Kenyan GAC adviser, Sammy Buruchara, dating to the ICANN meeting in Beijing, April 2013.
That was the meeting at which the GAC decided, by consensus, to issue advice to the effect that DCA’s .africa application should be trashed.
If Kenya, or any other single government, had disagreed with that proposed GAC advice, it would not be “consensus” advice and would therefore be substantially weakened when the ICANN board came to consider it.
Until his GAC appointment, Buruchara had been chair of DCA’s Strategic Leadership Advisory Board. DCA press released his move in March 2013.
It’s significant that Buruchara was not Kenya’s GAC voting “representative” — that was Michael Katundu — rather merely an “adviser”.
When Bekele (pictured here with Buruchara, March 7, 2013) was cross-examined during the IRP hearings in May this year, she was asked:

Q. Are you and he friends?
A. No.

Emails show that Buruchara had forwarded the proposed text of the GAC advice to Bekele, who then suggested three paragraphs of text saying the advice was “inappropriate” because the African Union Commission, as backer of the rival ZACR .africa bid, was a GAC member.
That email was dated April 10 — the Wednesday of the Beijing meeting — as the GAC was preparing its communique for submission to the ICANN board the following day.
It’s not clear from the emails published so far what, if anything, Buruchara did in response.
However, the next day, April 11, it seems his Kenyan government superiors were on his case. Buruchara told Bekele:

The matter has been escalated to our Government in Kenya with false information that I am contradicting the AUC.
I have responded accordingly.
Due to the sensitivity of this matter, I wish to leave it at the level of my previous post to the GAC until the matter settles.
Currently I am expecting a call from the President any time.

Expecting a call from the president was a big deal — Uhuru Kenyatta had been inaugurated just two days earlier following a month-long “hanging chads”-style legal challenge to his March 9 presidential election victory.
Buruchara elaborated in a subsequent email:

Someone from AUC called Ndemo and made a lot of noise to the effect that I have contradicted the Heads of State agreement in Abuja, which is obviously lies.
So Ndemo is beside himself with madness owing to the current transition process.
Anyhow I will try and manage the situation as I have not anywhere contradicted AUC’s position.

The “transition” he refers to is Kenyatta’s transition into government, not the ICANN/IANA transition.
“Ndemo” was actually Bitange Ndemo, then the Kenyan permanent secretary for information and communications, somebody Bekele had been simultaneously lobbying for Kenyan government support.
Buruchara was not in Beijing. The actual GAC rep, Katundu, went along with the GAC consensus against DCA.
In fact, Kenya had already issued a GAC Early Warning (pdf) against DCA, so it was significant that Buruchara was expressing support for the company.
In a second email thread, dated July 8, 2013, Buruchara seems to acknowledge that he aided DCA in some way but suggests that was only possible because of political instability in Kenya:

I am glad to note that DCA application passed all the stages except the GNP [Geographic Names Panel].
As you know I stuck my neck out for DCA inspite of lack of Govt support by Ndemo.
Going forward, I would certainly be ready to support DCA so long as the Kenya Govt is behind me as I do not think I will have the same chances as I had last time which was because the govt was in transition

In these July emails, which came less than a week after DCA’s application was rejected by the ICANN board, Bekele encourages Buruchara to file a challenge on behalf of Kenya, and to try to recruit other friendly governments to its cause.
Nothing ever came of that.
Buruchara’s alleged actions were one of the controversial points argued over in the DCA Independent Review Process case.
Many pages of the relevant evidence and argument related to Buruchara’s actions (or lack thereof) are still redacted by ICANN as “GAC Confidential”, so we don’t have all the facts.
However, the IRP proceedings revealed that Buruchara had emailed the GAC mailing list just before Beijing kicked off with reference to .africa.
According to DCA, Buruchara “explained that Kenya supported the AUC’s application for .AFRICA but did not think it was appropriate for the AUC to utilize the GAC to eliminate competition”.
Complicating matters further, there was a third Kenyan GAC “representative” in the mix, Alice Munyua.
She had been the Kenyan GAC rep, but according to DCA had left the position prior to Beijing. She was also involved in the ZACR application and the AUC .africa project.
The record shows that she spoke strongly against DCA’s application, as Kenyan GAC rep, during a meeting between the ICANN board and GAC in Beijing, April 9.
Buruchara, according to DCA, had told the GAC mailing list that Munyua was no longer a GAC rep and that the Kenyan government did not agree with her position. He was then evidently talked out of his position by other GAC members.
It’s not clear from the record whether Munyua was an authorized Kenyan GAC rep in Beijing or not. Archive.org shows her listed on the GAC’s member list in January 2013 but not May 2013.
It’s all very confusing, in other words.
What we seem to have in Beijing, at the least, is a Kenyan GAC delegation deeply divided and the possibility that one or more delegates tried to capitalize on political distractions back home.
With a partial record, it’s difficult to tell for sure.
.africa belongs to America
What’s more clear from the emails published by ICANN this week is that despite her claims to represent the African people, Bekele on at least two occasions told Kenyan officials that African governments had no right to .africa.
In one email to Ndemo, Bekele asserts that the US, rather than African governments, “owns” .africa. She wrote:

we do not believe that it is the place of African Presidents to give AU any sort of mandate for custodianship over a .africa resource that is owned by ICANN or US… the AU cannot do an RFP that is parallel to the ICANN process to appoint a registry on behalf of Africa as if they “own the resource”, which belongs to ICANN

This is in tune with Bekele’s repeated outreach to the US Congress to intervene in the .africa controversy.
While DCA is based in Mauritius, Bekele has stated in interviews that she’s lived in California for the better part of two decades.
More astroturf?
The newly published emails also show Bekele unsuccessfully lobbying Ndemo for Kenyan government support, in part by sending him links to purportedly independent domain “news” blogs that are widely believed to be under her own control.
In February 2013, Bekele sent Ndemo links to articles published on domainnewsafrica.com and domainingafrica.com.
These two domains were originally registered by Bekele, at her California business address, on November 21, 2011.
The Whois details for both domains disappeared behind Go Daddy’s privacy service on May 12, 2012, records archived by DomainTools show.
Both web sites take strongly pro-DCA views in matters relating to .africa and ICANN. Neither covers African domain name news except to the extent it relates to DCA or .africa.
Given that Bekele has a admitted history of using bogus identities to fake support for DCA, it’s my view that the sites are nothing more than astroturf/sock-puppetry.
domainingafrica.com is the site that accused me of being part of a racial conspiracy.
It’s worrying that this site was also being used to lobby government officials.
It’s perhaps fitting that Bekele’s email signature, in the newly unredacted emails, is “Nobody believes the official spokesman… but everybody trusts an unidentified source.”

Grogan hopeful of content policing clarity within “a few weeks”

ICANN may be able to provide registrars, intellectual property interests and others with clarity about when domain names should be suspended as early as next month, according to compliance chief Allen Grogan.
With ICANN 53 kicking off in Buenos Aires this weekend, Grogan said he intends to meet with a diverse set of constituents in order to figure out what the Registrar Accreditation Agreement requires registrars to do when they receive abuse complaints.
“I’m hopeful we can publish something in the next few weeks,” he told DI. “It depends to some extent on what direction the discussions take.”
The discussions center on whether registrars are doing enough to take down domains that are being used, for example, to host pirated content or to sell medicines across borders.
Specifically at issue is section 3.18 of the 2013 RAA.
It requires registrars to take “reasonable and prompt steps to investigate and respond appropriately” when they receive abuse reports.
The people who are noisiest about filing such reports — IP owners and pharmacy watchdogs such as LegitScript — reckon “appropriate action” means the domain in question should be suspended.
The US Congress heard these arguments in hearings last month, but there were no witnesses from the ICANN or registrar side to respond.
Registrars don’t think they should be put in the position of having to turn off what may be a perfectly legitimate web site due to a unilateral complaint that may be flawed or frivolous.
ICANN seems to be erring strongly towards the registrars’ view.
“Whatever the terms of the 2013 RAA mean, it can’t really be interpreted as a broad global commitment for ICANN to enforce all illegal activity or all laws on the internet,” Grogan told DI.
“I don’t think ICANN is capable of that, I don’t think we have the expertise or resources to do that, and I don’t think the ICANN multistakeholder community has ever had that discussion and delegated that authority to ICANN,” he said.
CEO Fadi Chehade recently told the Washington Post that it isn’t ICANN’s job to police web content, and Grogan has expanded on that view in a blog post last week.
Grogan notes that what kind of content violates the law varies wildly from country to country — some states will kill you for blasphemy, in some you can get jail time for denying the Holocaust, in others political dissent is a crime.
“Virtually everybody I’ve spoken with has said that is far outside the scope of ICANN’s remit,” he said.
However, he’s leaving some areas open for discussion,
“There are some constituents, including some participants in the [Congressional] hearing — from the intellectual property community and LegitScript — who think there’s a way to distinguish some kinds of illegal activities from others,” he said. “That’s a discussion I’m willing to have.”
The dividing line could be substantial risk to public health or activities that are broadly, globally deemed to be illegal. Child abuse material is the obvious one, but copyright infringement — where Grogan said treaties show “near unanimity” — could be too.
So is ICANN saying it’s not the content police except when it comes to pharmacies and intellectual property?
“No,” said Grogan. “I’m saying I’m willing to engage in that dialogue and have that conversation with the community to see if there’s consensus that some activities are different to others.”
“In a multistakeholder model I don’t think any one constituency should control,” he said.
In practical terms, this all boils down to 3.18 of the RAA, and what steps registrars must take to comply with it.
It’s a surprisingly tricky one even if, like Grogan, you’re talking about “minimum criteria” for compliance.
Should registrars, for example, be required to always check out the content of domains that are the subject of abuse reports? It seems like a no-brainer.
But Grogan points out that even though there could be broad consensus that child abuse material should be taken down immediately upon discovery, in many places it could be illegal for a registrar employee to even check the reported URL, lest they download unwanted child porn.
Similarly, it might seem obvious that abuse reports should be referred to the domain’s registrant for a response. But what of registrars owned by domain investors, where registrar and registrant are one and the same?
These and other topics will come up for discussion in various sessions next week, and Grogan said he’s hopeful that decisions can be made that do not need to involve formal policy development processes or ICANN board action.

Is the Defending Internet Freedom Act pro-crime?

The Defending Internet Freedom Act of 2015, introduced to the US Congress last month, contains a provision that could be interpreted as pro-pron, pro-piracy or even just pro-crime.
The act is designed to prevent the US giving up its oversight of ICANN/IANA unless certain quite strict conditions are met.
It’s a revised version of a bill that was introduced last year but didn’t make it through the legislative process.
Like the 2014 version, it says that the US cannot sever ties with ICANN until its bylaws have been amended in various ways, including:

ICANN is prohibited from engaging in activities unrelated to ICANN’s core mission or entering into an agreement or modifying an existing agreement to impose on a registrar or registry with which ICANN conducts business any condition (such as a condition relating to the regulation of content) that is unrelated to ICANN’s core mission.

It’s the “regulation of content” bit that caught my eye.
Presumably written as a fluffy, non-controversial protection against censorship, it ignores where the real content regulation conversations are happening within the ICANN community.
It’s a constant mantra of ICANN that is “doesn’t regulate content”, but the veracity of that assertion has been chipped away relentlessly over the last several years by law enforcement, governments and intellectual property interests.
Today, ICANN’s contracts are resplendent with examples of what could be argued is content regulation.
Take .sucks, for a timely example. Its Registry Agreement with ICANN contains provisions banning pornography, cyber-bulling and parked pages.
That’s three specific types of content that must not be allowed in any web site using a .sucks domain.
It’s one of the Public Interest Commitments that were voluntarily put forward by .sucks registry Vox Populi, but they’re still enforceable contract provisions.
Using a dispute resolution process (PICDRP), ICANN would be able to levy fines against Vox Pop, or terminate its contract entirely, if it repeatedly allows porn in .sucks web sites.
This sounds quite a lot like content regulation to me.
It’s not just .sucks, of course. Other registries have PICs that regulate the content of their gTLDs.
And every contracted new gTLD registry operator has to agree to this PIC:

Registry Operator will include a provision in its Registry-Registrar Agreement that requires Registrars to include in their Registration Agreements a provision prohibiting Registered Name Holders from distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law, and providing (consistent with applicable law and any related procedures) consequences for such activities including suspension of the domain name.

It’s convoluted, but it basically indirectly forces (via registrars) new gTLD domain registrants to, for example, agree to not infringe copyright.
The PIC is paired with a provision (3.18) of the 2013 Registrar Accreditation Agreement that requires all registrars to investigate and “take necessary and appropriate actions” in response to abuse reports within 24 hours of receipt.
Section 3.18 is essentially the RAA mechanism through which ICANN can enforce the PIC from the RA.
This is currently one of the most divisive issues in the ICANN community, as we witnessed during the recent Congressional hearings into ICANN oversight.
On the one hand, big copyright owners and online pharmacy watchdogs want ICANN to act much more ruthlessly against registrars that fail to immediately take down sites that they have identified as abusive.
On the other hand, some registrars say that they should not have to engage in regulating what content their customers publish, at least without court orders, in areas that can sometimes be amorphously grey and fuzzy.
Steve Metalitz, from a trade group that represents the movie and music industies at ICANN, told the US Congress that registrars are dismissing piracy reports without investigating them, and that “unless registrars comply in good faith, and ICANN undertakes meaningful and substantive action against those who will not, these provisions will simply languish as empty words”.
John Horton from pharmacy watchdog used the same Congressional hearing to out several registrars he said were refusing to comply with 3.18.
One Canadian registrar named in Horton’s testimony told DI that every complaint it has received from LegitScript has been about a web site that is perfectly legal in Canada.
In at least some cases, it seems that those pushing for ICANN to more stringently regulate content may have “internet freedom” as the least of their concerns.
If the Defending Internet Freedom Act becomes law in the US, perhaps it could prove a boon to registries and registrars upset with constant meddling from rights owners and others.
On the other hand, perhaps it could also prove a boon for those operating outside the law.

.sucks and ICANN not invited to Congressional hearing on .sucks and ICANN

The witness list in next week’s US Congressional hearing into .sucks and ICANN accountability does not feature .sucks or ICANN.
The eight witnesses are largely drawn from outspoken critics of both ICANN and Vox Populi, either companies or trade associations and lobby groups. It’s stacked heavily in favor of intellectual property interests.
The hearing is titled “Stakeholder Perspectives on ICANN: The .sucks Domain and Essential Steps to Guarantee Trust and Accountability in the Internet’s Operation”.
With hindsight, the “Stakeholder Perspectives” bit gives away the fact that the judiciary subcommittee holding the hearing is more concerned with listening to ICANN’s critics than ICANN itself.
Mei-lan Stark, a senior intellectual property lawyer from Fox and 2014 president of the International Trademark Association, tops the list.
A critic of the new gTLD program, in 2011 Stark told Congress that the first round of new gTLDs would cost Fox “conservatively” $12 million in defensive registration fees.
It will be interesting to see if any Congresspeople confront Stark about that claim, which appeared like a gross overstatement even at the time.
One company that has been enthusiastically embracing new gTLDs — as an applicant, registry, defensive and non-defensive registrant — is Amazon, which has VP of global public policy Paul Misener on the panel.
Amazon has beef with ICANN for siding with the Governmental Advisory Committee over the battle for .amazon, which Amazon has been banned from obtaining, so it’s difficult to see the company as an overly friendly witness.
Next up is John Horton, president of LegitScript, the company that certifies legitimate online pharmacies and backs the .pharmacy new gTLD.
LegitScript is in favor of greater regulation of the domain name industry in order to make it easier to shut down potentially dangerous web sites (though opponents say it’s more often more interested in protecting Big Pharma’s profit margins). This month it called for a ban on Whois privacy for e-commerce sites.
Steve Metalitz, counsel for the Coalition for Online Accountability (a lobbyist for the movie and music industries) and six-term president of the ICANN Intellectual Property Constituency, is also on the list.
Jonathan Zuck, president of ACT The App Association (aka the Association for Competitive Technology, backed by Verisign and other tech firms) is on the list.
NetChoice director Steve DelBianco is also showing up again. He’s an ICANN hearing mainstay and I gather with this appearance he’ll be getting the final stamp on his Rayburn Building Starbucks loyalty card. That means a free latte, which is always nice.
Internet Commerce Association counsel Phil Corwin is a surprise invitee. ICA represents big domainers and is not a natural ally of the IP side of the house.
Bill Woodcock, executive director of Packet Clearing House, rounds off the list. PCH might not have instant name recognition but it provides Anycast DNS infrastructure services for scores of ccTLDs and gTLDs.
The committee hearing will take place at 10am local time next Wednesday.
A second hearing, entitled “Stakeholder Perspectives on the IANA Transition” will be held four hours later by a subcommittee of the House Energy & Commerce committee. The witnesses for that one have not yet been announced.
It’s going to be a busy day for ICANN bods on Capitol Hill.

Congress to put .sucks on trial

The US Congress is to hold a hearing to look into the .sucks gTLD and ICANN accountability.
A hearing entitled “Stakeholder Perspectives on ICANN: The .sucks Domain and Essential Steps to Guarantee Trust and Accountability in the Internet’s Operation” has been scheduled by the House Subcommittee on Courts, Intellectual Property, and the Internet
It will take place in Washington DC next Wednesday, May 13.
The list of witnesses does not yet appear to have been published.
I would guess we’d be looking at, at the very least, somebody senior from ICANN, somebody senior from .sucks registry Vox Populi, and an intellectual property lawyer.
It was ICANN’s Intellectual Property Constituency that complained about .sucks’ sunrise policies and fees, causing ICANN to refer the matter to US and Canadian trade regulators.
The title of the House hearing suggests that the .sucks controversy will be inextricably tied to the broader issue of ICANN accountability, which is currently undergoing a significant review as ICANN seeks to split permanently from US government oversight.
That’s not great optics for ICANN; I’m sure the organization would rather not have its performance judged on what is quite an unusual edge case emerging from the new gTLD program.

Chehade to face Congressional grilling this week

ICANN CEO Fadi Chehade is heading to Washington DC this week to defend plans to decouple the organization from formal US oversight in front of a potentially hostile committee of Congresspeople.
The Senate Committee on Commerce, Science, and Transportation will meet this Wednesday at 1000 local time to grill Chehade and others on the plan to remove the US government from the current triumvirate responsible for managing changes to the DNS root zone under the IANA arrangements.
He will be joined by Larry Strickling, who as head of the National Telecommunications and Information Administration is the US government’s point person on the transition, and Ambassador David Gross, a top DC lawyer formerly with the Department of State.
All three men are pro-transition, while the Republican-tilted committee is likely to be much more skeptical.
The blurb for the Wednesday hearing reads:

As the U.S. government considers relinquishing control over certain aspects of Internet governance to the private sector, concerns remain that the loss of U.S. involvement over the Internet Assigned Numbers Authority (IANA) could empower foreign powers — acting through intergovernmental institutions or other surrogates — to gain increased control over critical Internet functions.

Republicans and right-leaning media commentators have warned that handing over IANA oversight to a multistakeholder body risks giving too much power to governments the US doesn’t like, such as Russia and China.
Several bills introduced in the House and Senate over the last year would have given Congress much more power to delay or deny the transition.
An amendment to an appropriations bill approved in December prevents the NTIA from spending any taxpayer money on relinquishing its DNS root oversight role until after September 30 this year, the same day that the current IANA contract expires.
This effectively prevents a transition during the current IANA contract’s run. Strickling recently said that the NTIA is complying with this legislation, but noted that it does not prevent the agency participating in the development of the transition proposal.
ICANN community working groups are currently working on plans for ICANN oversight post-NTIA and for addressing ICANN accountability.
These documents are hoped to be ready to sent to the NTIA by July, so the NTIA will have enough time to consider them before September 30.
Strickling recently addressed this date in a speech at the State of the Net conference in Washington, saying:

I want to reiterate again that there is no hard and fast deadline for this transition. September 2015 has been a target date because that is when the base period of our contract with ICANN expires. But this should not be seen as a deadline. If the community needs more time, we have the ability to extend the IANA functions contract for up to four years. It is up to the community to determine a timeline that works best for stakeholders as they develop a proposal that meets NTIA’s conditions, but also works.

Opponents of the transition say that because the NTIA is prevented from terminating the IANA contract before October 1, the NTIA will have no choice but to extend it until September 30, 2017.
Given that 2016 is a presidential election year in the US, Barack Obama would be a private citizen again by the time the next opportunity to transition comes around, they say.
Which presidential hopeful — from either party — would not buckle if asked whether he supports a plan to let Iran run the internet? That’s the political logic at work here.
Chehade himself told the AFP news agency earlier this month that the transition would have to happen before the 2016 elections, to avoid political distractions.
I’m not so sure I agree with the premise that, due to the restraints imposed by the appropriation bill, the transition now has to happen under the next president’s administration.
In my layman’s reading of the current IANA contract, the NTIA is able to terminate it for the “convenience of the government” pretty much whenever it wants.
There’s also an option to extend the contract by up to six months. The NTIA exercised this option in March 2012 when it did not approve of ICANN’s first renewal proposals.
