Plural gTLDs could be a casualty as ICANN accepts big chunk of GAC advice

ICANN has accepted nine pieces of Governmental Advisory Committee advice pertaining to new gTLDs, essentially killing off two applications and putting question marks over many more.
Notably, the question of whether plural and singular versions of the same string should be allowed to coexist has been reopened for debate, affecting as many as 98 applications.
ICANN’s New gTLD Program Committee, which carries board powers but does not include directors with conflicts of interest, this week passed a resolution that addresses a good chunk of the GAC’s Beijing communique.
It does not discuss any of the amorphous “safeguard” advice from the document, which was subject to a recently closed public comment period and is likely to take much longer to resolve.
By far the line item with the broadest immediate impact is this:

The NGPC accepts this advice and will consider whether to allow singular and plural versions of the same string.

That’s right folks, singular and plural gTLDs (eg, .car and .cars) may not be allowed to coexist after all.
Using a broad interpretation (that treats .new and .news as clashes, for example), 98 applications could be affected by this decision.
Singular vs plural is a contentious issue with some strongly held religious views. Whether you come down on one side or the other depends largely on how you see new gTLDs being used in future.
Proponents of coexistence see a future of 30,000 gTLDs being used as direct navigation and search tools, while opponents worry about the risk of freeloading plural registries making a killing from unnecessary defensive registrations.
The NGPC did not say how the debate would be moved forward, but I’d be surprised if it didn’t involved the broader community through public comments or meetings in Durban next month.
Ding dong…?
Two line items appear to put the final nails in the coffins of two new gTLD applications: DotConnectAfrica’s .africa and GCCIX WLL’s .gcc.
Both clash with the names of geographic regions (.gcc is for Gulf Cooperation Council, a name often associated with nations in the Arabian/Persian Gulf) and received the GAC’s strongest possible form of objection.
In both cases, the NGPC said the applications “will not be approved” and invited the applicants to withdraw.
However, it gave both applicants the right to appeal using “ICANN’s accountability mechanisms”.
Islamic strings on life support
Some governments in the GAC had taken issue with the applications for strings such as .islam and .halal, and the NGPC said it “stands ready to enter into dialogue with the GAC on this matter”.
That’s the Applicant Guidebook-mandated response when the GAC cannot reach a consensus that an application should be killed off.
Amazon among geo strings delayed
As expected, the NGPC decided to work with the GAC’s extended timetable for the consideration of 19 applications whose chosen strings clash with geographic names such as .thai and .persiangulf.
Basically, the GAC asked for more time to discuss them.
In response, ICANN will not delay Initial Evaluation for these applications, but it will not sign contracts with the applicants until the GAC has issued its final advice.
The list includes two big trademarks: retail giant Amazon and the clothing brand Patagonia.
Both will have to wait until at least Durban to discover their fate.
The list also includes .wine and .vin, because some in the wine industry have been kicking up a stink about the protection of special geographic identifiers (eg Champagne, Bordeaux) at the second-level.
Weasel words on community objections
There’s one piece of advice that the NGPC said it has “accepted” but which it clearly has not.
The GAC had said this:

The GAC advises the Board that in those cases where a community, which is clearly impacted by a set of new gTLD applications in contention, has expressed a collective and clear opinion on those applications, such opinion should be duly taken into account, together with all other relevant information.

I think any reasonable interpretation of this item would require ICANN or somebody else to make a subjective judgement call on which applications should win certain contention sets.
To my mind, the advice captures contested strings such as .book (where publishers hate the idea of Amazon running it as a closed generic) and .music (where the music industry favors a restricted registration policy).
But ICANN, always reluctant to have to pick winners and losers, seems to have chosen to interpret the advice somewhat differently. In its response, it states:

The NGPC accepts this advice. Criterion 4 for the Community Priority Evaluation process takes into account “community support and/or opposition to the application” in determining whether to award priority to a community application in a contention set. (Note however that if a contention set is not resolved by the applicants or through a community priority evaluation then ICANN will utilize an auction as the objective method for resolving the contention.)

I don’t think this covers the GAC’s advice at all, and I think the NGPC knows it.
As the parenthetical comment says, communities’ views are only taken into account if an applicant has filed a formal “Community” bid and chooses to resolve its contention set with a Community Priority Evaluation.
To return to the above examples, this may well capture .music, where at least one applicant intends to go the CPE route, but it does not capture .book, where there are no Community applications.
There are 33 remaining Community applications in 29 contention sets.
Will the GAC accept the NGPC’s response as a proper implementation of its advice? If it’s paying attention and feels strongly enough about the issue, my guess is probably not.
More special favors for the Olympics
The International Olympic Committee holds extraordinary power over governments, which has resulted in the GAC repeatedly humiliating itself by acting an Olympic lobbyist before the ICANN board.
In the Beijing communique, it asked ICANN to make sure that the temporary temporary protections granted to Olympics and Red Cross are made permanent in the Applicant Guidebook.
Prior to April, the Registry Agreement in the Guidebook said that the protected strings “shall be initially reserved”, but this language has been removed in the current version of the RA.
The NGPC said that this was due to the GAC’s advice. Box ticked.
But here’s the kicker: the protections will still be subject to a Generic Names Supporting Organization Policy Development Process.
In other words, the discussion is not over. The rest of the ICANN community will get their say and ICANN will try to reconcile what the GNSO decides with what the GAC wants at a later date.
While “accepting” the GAC’s advice, it’s actually proposing something of a compromise. The NGPC said:

Until such time as the GNSO approves recommendations in the PDP and the Board adopts them, the NGPC’s resolutions protecting IOC/RCRC names will remain in place. Should the GNSO submit any recommendations on this topic, the NGPC will confer with the GAC prior to taking action on any such recommendations.

New gTLD registries will not be able to argue in future that their contracts only require them to “initially” protect the Olympic and Red Cross strings, but at the same time the GNSO as a whole gets a say in whether permanent protections are warranted.
It seems like a pretty nice compromise proposal from ICANN — particularly given the problems it’s been having with the GNSO recently — but I doubt the GAC will see it that way.
Other stuff
There were two other items:

  • The GAC had advised that no new gTLD contracts should be approved until the 2013 Registrar Accreditation Agreement is finalized. ICANN agreed. It’s already built into the timetable.
  • The GAC wanted its existing views taken into account in the current, ongoing, formative discussions about a replacement service for Whois. That’s already happening.

In summary…
…it’s a pretty sensible response from the NGPC, with the exception of the weaselly response to the “community views” advice.
Taken as a whole, it’s notable for its respect for other stakeholders and processes, which is admirable.
Even in the case of .africa and .gcc, which I firmly believed would be dead today, it’s given the applicants the opportunity to go through the appropriate appeals channels.
The GAC, it seems, doesn’t even get the last word with its kiss of death.

Kiss-of-death gTLD applicant asks ICANN to reject “untimely” GAC advice

One of the only two companies to receive formal, consensus, kiss-of-death Governmental Advisory Committee advice last month has called on ICANN to reject it as “untimely”.
GCCIX WLL of Bahrain applied for .gcc to be an open gTLD for residents of the Persian/Arabian Gulf region.
It was a ballsy application. The intended meaning of the string was Gulf Cooperation Council — the six-state regional political union — but the applicant by its own admission had no support from local governments or the GCC itself.
It would be a little like applying for .eu, to represent Europe, with no support from the European Union.
Naturally enough, local governments balked. GCCIX received an Early Warning signed by Bahrain, Oman, Qatar and the United Arab Emirates, followed by a legal rights objection from the GCC itself.
And in Beijing, the GAC said by consensus that the application for .gcc should be rejected.
The only other application that received the same level of advice was DotConnectAfrica’s equally unsupported application for .africa which, unlike .gcc, ICANN recognizes as “geographic”.
Now, GCCIX CEO Fahad AlShirawi has written to ICANN to ask it to reject the GAC’s advice and let the legal rights objection process play out before making a decision.
Of note, AlShirawi points out that the GAC advice was received in April, a month later than the deadline outlined in the new gTLD program’s Applicant Guidebook.
ICANN should therefore reject the GAC advice as “untimely”, he wrote.
That’s not going to happen, of course.
The GAC is allowed to provide advice to ICANN at any time, no matter what the Guidebook says. If ICANN were to ignore it based on timing, it may as well sign its own death sentence at the same time.

GAC delivers sweeping advice that will delay scores of new gTLDs by months

ICANN’s Governmental Advisory Committee has issued the kiss of death to two new gTLD applications and sweeping advice that will delay many, many more.
In its Beijing communique, issued this hour, the GAC as expected delivered advice against whole categories of gTLDs and provided a lengthy but “non-exhaustive” list of affected bids.
First, the GAC said that the .africa bid filed by DotConnectAfrica and the .gcc bid filed by GCCIX WLL should be rejected. Those were full consensus objections.
Two gTLDs related to Islam: .islam and .halal, have non-consensus objections, and will now have to be considered by the ICANN board of directors directly.
The GAC also said it needed more time, until ICANN’s meeting in Durban this July, to consider delivering specific advice against 14 more:

the GAC advises the ICANN Board to: not proceed beyond Initial Evaluation with the following strings: .shenzhen (IDN in Chinese), .persiangulf, .guangzhou (IDN in Chinese), .amazon (and IDNs in Japanese and Chinese), .patagonia, .date, .spa, .yun, .thai, .zulu, .wine, .vin

On the issue of plurals versus singulars, the GAC said ICANN should “Reconsider its decision to allow singular and plural versions of the same strings.” This affects about 60 applications.
But it doesn’t end there.
As predicted, the GAC has also issued swathes of advice against scores of proposed gTLDs in 12 categories: children, environmental, health and fitness, financial, gambling, charity, education, intellectual property, professional services, corporate identifiers, generic geographical terms and inherently governmental functions.
A “non-exhaustive” list of applications has been provided for each category, covering well over 100, setting the stage for a fight over inclusion for any application that the GAC forgot about.
If the GAC gets its way, any application that falls into one of these categories will have to have enhanced regulations governing Whois, abuse mitigation, and security.
The GAC also has its say on “closed generics”, which it calls “exclusive registry access” strings. They should only be awarded if they serve a public interest purpose, the GAC said.
In short, the advice is extraordinarily broad and seems to delegate the considerable work of picking through the mess to ICANN.

GAC threat looms over ICANN Beijing

How the Governmental Advisory Committee handles its advice on new gTLD applications seems to be a big worry at the ICANN public meeting in Beijing this week.
During a session yesterday, new gTLD program vice president Christine Willett was peppered with questions about the approval process going forward, many of which related to the GAC.
There’s also a lot of gossiping about which applications the GAC is thinking about delivering the kiss of death to, and what its advice will mean to the overall program timetable.
DI is not attending the Beijing meeting in person, but here’s what I’ve learned from remote participation and talking to attendees:
Confusion over the GAC Advice standard
Judging by interactions during Willett’s session, there may be a little bit of confusion about whether GAC Advice needs to be “consensus” GAC Advice in order to halt a new gTLD application.
I think the confusion is mainly due to the way some people (Willett and myself included) use phrases such as “non-consensus GAC Advice” as shorthand for a particular paragraph of the Applicant Guidebook.
Here’s the way I understand it:
All GAC Advice — including Advice sent on issues completely unrelated to the new gTLD program — is consensus GAC Advice.
If the GAC sends written Advice to the ICANN board, it means the GAC has reached consensus to send that Advice, even if the Advice itself reflects a lack of consensus on the specifics.
Confusion in the community is arising now because the Applicant Guidebook also talks about three types of “GAC Advice on New gTLDs”, the first of which is:

The GAC advises ICANN that it is the consensus of the GAC that a particular application should not proceed. This will create a strong presumption for the ICANN Board that the application should not be approved.

That’s describing a situation where the GAC has reached a consensus that an application should be rejected. It’s going to sound the death knell for several applications, without doubt.
The second type of GAC Advice on New gTLDs in the Guidebook is:

The GAC advises ICANN that there are concerns about a particular application “dot-example.” The ICANN Board is expected to enter into dialogue with the GAC to understand the scope of concerns. The ICANN Board is also expected to provide a rationale for its decision.

The language was written by the GAC, using its consensus model, which is why it’s so badly worded.
What it means is that the GAC could not find consensus to kill off an application — some governments want it killed off, some don’t — but that the GAC as a whole reached consensus to tell ICANN that some governments do want it killed off.
So when people talk about “non-consensus” Advice, we’re referring to this second form of GAC Advice on New gTLDs, where the GAC could reached consensus to alert ICANN about “concerns” but could not reach consensus that the application should be taken outside and shot.
Which applications are going to get Advice?
The GAC stated last week that 20 applications had been put forward for specific review at the Beijing meeting.
From what I’ve been able to piece together from the GAC’s public hints, its Early Warnings, and sources in Beijing, I think I’ve identified many of these applications.
I’m pretty certain that DotConnectAfrica’s application for .africa is going to get killer Advice.
I’m not picking on DCA (disclosure: DCA accused me of being part of a racist conspiracy) but it is the only remaining applicant to comprehensively ignore ICANN’s rules on geographic names.
It’s also well-known that Amazon’s application for .amazon (and translations), and Patagonia Inc’s application for .patagonia, both of which were not captured by ICANN’s rules on geography, are unloved by Latin American governments.
The Montevideo Declaration, signed by government ministers from the continent last week, specifically condemns any new gTLDs related to Amazonia and Patagonia.
It’s difficult to see how the GAC could ignore the strength of this position, but it’s always possible that some members may have been lobbied into submission by applicants, therefore spoiling consensus.
Other geographic strings that ICANN’s rules did not identify as geographic may also face Advice.
It’s known that .persiangulf, for example, is racially/culturally divisive because the same body of water is also known as the Arabian Gulf by Arab states in the region.
The Japanese government’s Early Warning against .date (issued because there are two cities in Japan that, when translated into Latin characters, are called Date) is also believed to have been put forward for formal GAC Advice.
Outside of geographic names, I hear that .basketball and .rugby are also on the GAC’s shortlist.
These are interesting cases because the governments with the beef (Greece and the UK) are not concerned about the strings themselves. Rather, they want to make sure their preferred applicant wins.
Both gTLDs are contested, and each contention set has one applicant backed by the official world authority for the sport concerned.
If the GAC issues Advice on either, it’s putting itself in the position of picking winners and losers, which could make for some frenetic lobbying in future application rounds.
The application for .uno is believed to be under discussion in the GAC because it clashes with the acronym of an intergovernmental organization.
It also seems pretty certain that Demand Media’s applications for .navy, .army and .airforce are going to get Advice in one form or another. The US, I gather, is adamant that these bids should be rejected at all costs.
How GAC Advice affects the timetable
Willett said yesterday that ICANN expects to receive the GAC’s Advice this week, which should come as some relief to applicants given that the timing has always been a bit vague.
But it’s still not clear what form the Advice will take.
Sure, there’s bound to be some bits of Advice that call out specific applications for death-by-board, but there may also be Advice that addresses certain “categories” of application.
If that happens, and the GAC does not explicitly state which applications fall into which category, there’s the potential for mass confusion following the Beijing meeting.
I raised this specter last week, and it cropped up again during Willett’s session in Beijing yesterday.
What I forgot about last week, and what Willett was quizzed about yesterday, is that the Guidebook gives applicants with GAC Advice 21 days to respond to it before the ICANN board acts.
“I’m concerned that whereby the GAC Advice is such that it is all-encompassing and non-exhaustive that therefore all applicants must respond and all applicants are waiting another 21 days,” ARI Registry Services CEO Adrian Kinderis asked. “No applicant can proceed, because they’re all impacted.”
“If that hypothetical situation occurs, I think that’s possible,” Willett responded.
I other words, if the GAC delivers broad advice this week that does not name specific applications, it’s possible that every applicant would have 21 days to tell ICANN’s board why they’re not affected.
That would completely balls up ICANN’s plan to sign its first registry agreements on April 23.

Six big reasons we won’t see any new gTLD launches until Q3

ICANN’s announcement of a big media bash in New York on April 23, to announce the launch of new gTLDs, has gotten many people thinking the first launches are imminent.
Wrong.
We’re not going to see any new gTLD domains on sale until the third quarter at the earliest, in my view, and here are a few good reasons why.
April 23 is just a PR thing
ICANN has said that April 23 is primarily about awareness-raising.
Not only does it hope to garner plenty of column inches talking about new gTLDs — helping the marketing efforts of their registries — it also hopes to ceremonially sign the first Registry Agreements.
I think CEO Fadi Chehade’s push to make the industry look more respectable will also play a part, with the promotion of the Registrant Rights and Responsibilities document.
But there’s never been any suggestion that any strings will be delegated at that time, much less go live.
The contracts are still hugely controversial
If ICANN wants to sign a Registry Agreement on April 23, it’s going to need a Registry Agreement to sign.
Right now, applicants are up in arms about ICANN’s demand for greater powers to amend the contract in future.
While ICANN has toned down its proposals, they may still be unacceptable to many registries and gTLD applicants.
Applicants have some impetus to reach agreement quickly — because they want to launch and start making money as soon as possible.
But ICANN wants the same powers added to the 2013 Registrar Accreditation Agreement, and registrars are generally less worried about the speedy approval of new gTLDs.
ICANN has tied the approval of the RA and the RAA together — only registrars on the new RAA will be able to sell domains in new gTLDs.
Chehade has also made it clear that agreement on the new RAA is a gating issue for new gTLD launches.
If registries, registrars and ICANN can’t settle these issues in Beijing, it’s hard to see how any contracts could be signed April 23. The first launch would be delayed accordingly.
GAC Advice might not be what we’re expecting
GAC Advice on New gTLDs is, in my view, the biggest gating issue applicants are facing right now.
GAC Advice is an integral part of the approval process outlined in the Applicant Guidebook and ICANN has said many times that it cannot and will not sign any contracts until the GAC has spoken.
But what does that mean from a process and timing point of view?
According to the Applicant Guidebook, if an application receives GAC Advice, it gets shunted from the main evaluation track to the ICANN board of directors for consideration.
It’s the only time the ICANN board has to get directly involved with the approval process, according to the Guidebook’s rather complex flow-charts.
GAC Advice is not an automatic death sentence, but any application the GAC is unanimously opposed to stands a very slim chance of getting approved by the board.
Given that ICANN is has said it will not sign contracts until it has received GAC Advice, and given that it has said it wants to sign the first contract April 23, it’s clearly expecting to know which applications are problematic and which are not during the next three weeks.
But I don’t think that’s necessarily going to happen. The GAC moves slowly and it has a track record of missing ICANN-imposed deadlines, which it often seems to regard as irksome.
Neither ICANN nor the GAC have ever said GAC Advice on New gTLDs will be issued during next week’s public meeting in Beijing. If a time is given it’s usually “after” or “following” Beijing.
And I don’t think the GAC, which decided against holding an inter-sessional meeting between Toronto and Beijing, is remotely close to providing a full list of specific applications of concern.
I do think a small number of slam-dunk bad applications – such as DotConnectAfrica’s .africa bid – will get Advised against during or after the Beijing meeting.
But I also think the GAC is likely to issue Advice that is much broader, and which may not provide the detail ICANN needs to carry the process forward for many applicants.
The GAC, in its most recent (delayed) update, is still talking about “categories” of concern – such as “consumer protection” and “geographical names” – some of which are very broad indeed.
Given the limited amount of time available to it in Beijing, I think it’s quite likely that the GAC is going to produce advice about categories as well as about individual applications.
And, crucially, I don’t think it’s necessarily going to give ICANN a comprehensive list of which specific applications fall into which categories.
If the GAC decides to issue Advice under the banner of “consumer protection”, for example, somebody is going to have to decide which applications are captured by that advice.
Is that just strings that relate to regulated industries such as pharmaceuticals or banking? Or is it any string that relates to selling stuff? What about .shop and .car? Shops and cars are “regulated” by consumer protection and safety laws in most countries.
Deciding which Advice covered which applications would not be an easy task, nor would it be a quick one. I don’t think the GAC has done this work yet, nor do I think it will in Beijing.
For the GAC to reach consensus advice against specific applications will in some cases require GAC representatives to return to their capitals for guidance, which would add delay.
There is, in my view, a very real possibility of more discussions being needed following Beijing, just in order to make sense of what the GAC comes up with.
The new gTLD approval process needs the GAC to provide a list of specific applications or strings with which it has concerns, and we may not see that before April 23.
ICANN may get a short list of applications that definitely do have Advice by then, but it won’t necessarily know which applications do not, which may complicate the contract-signing process.
The Trademark Clearinghouse still needs testing
The Trademark Clearinghouse is already, in one sense, open for business. Trademark owners have been able to submit their marks for validation for a couple of weeks now.
But the hard integration work has not been done yet, because the technical specifications the registries and registrars need to interface with IBM’s TMCH database have not all been finalized.
When the specs are done (it seems likely this will happen in the next few weeks), registries and registrars will need to finish writing their software and start production testing.
ICANN’s working timetable has the TMCH going live July 1, but companies that know much more than me about the technical issues at play here say it’s unlikely that they’ll be ready to go live with Sunrise and Trademark Claims services before August.
It’s in everyone’s interests to get all the bugs ironed out before launch.
For new gTLD registries, a failure of the centralized TMCH database could mean embarrassing bugs and downtime during their critical launch periods.
Trademark owners and domain registrants may also be concerned about the potential for loopholes.
For example, it’s still not clear to some how Trademark Claims – which notifies registrants when there’s a clash between a trademark and a domain they want – will interact with landrush periods.
Does the registrant only get a warning when they apply for the domain, which could be some weeks before a landrush auction? If so, what happens if a mark is submitted to the TMCH between the application and the auction and ultimate registration?
Is that a loophole to bypass Trademark Claims? Could a registrant get hit by a Claim after they’ve just spent thousands to register a domain?
These are the kinds of things that will need to be ironed out before the TMCH goes fully live.
There’s a sunrise notice period
The sunrise period is the first stage of launch in which customers get to register domain names.
Lest we forget, ICANN recently decided to implement a mandatory 30-day notice period for every new gTLD sunrise period. This adds a month to every registry’s go-live runway.
Because gTLD sunrise periods from now on all have to use the TMCH, registries may have to wait until the Clearinghouse is operational before announcing their sunrise dates.
If the TMCH goes live in July, this would push the first launch dates out until August.
Super-eager registries may of course announce their sunrise period as soon as they are able, and then delay it as necessary to accommodate the TMCH, but this might carry public relations risks.
Verisign’s security scare
It’s still not clear how Verisign’s warning about the security risks of launching new gTLDs on the current timetable will be received in Beijing.
If the GAC reckons Verisign’s “concerns” are valid, particularly on the issue of root zone stability, ICANN will have to do a lot of reassuring to avoid being advised to delay its schedule.
Could ICANN offer to finish off its work of root zone automation, for example, before delegating new gTLDs? To do so would add months to the roll-out timetable.

Governments expand gTLD objection shortlist

With the start of its meetings in Beijing just a couple of days away, ICANN’s Governmental Advisory Committee has handed out clues as to which new gTLDs it might object to.
The GAC says that 20 specific bids have already been put forward by one government as potential recipients of GAC Advice, but that there are nine broad categories of concern.
Some of the categories seem to obviously apply to certain narrow types of gTLD, while others are broad enough to catch almost any bid the GAC doesn’t like the look of.
Any application that receives adverse GAC Advice at the end of the Beijing meeting faces, at the very least, a prolonged approval process along the lines of what .xxx had to endure.
The worst-case scenario is rejection of the bid by the ICANN board of directors.
These are the GAC’s categories, along with some educated guesses about which strings they could apply to:

  • “Consumer protection” — could apply to anything, depending on how well-lobbied the GAC has been by a particular interest group. Any gTLD that could implausibly be argued to increase the risk of counterfeiting may show up here. A liberal interpretation could well capture .music or sports-related strings.
  • “Strings that are linked to regulated market sectors, such as the financial, health and charity sectors” — Dozens of applications, such as those for .lawyer, .doctor, .health .bank, and .charity — will fall into this category.
  • “Competition issues” — This most likely applies to applications for category-killer dictionary words where the applicant is already a dominant player in the relevant market, such as Google’s bid for .search or Amazon’s for .book.
  • “Strings that have broad or multiple uses or meanings, and where one entity is seeking exclusive use” — Again, this could apply to the many controversial “closed” gTLD applications.
  • “Religious terms where the applicant has no, or limited, support from the relevant religious organisations or the religious community” — I suspect that the the Vatican’s application for .catholic is less at risk than a Turkish company’s bid for .islam. Any Islam-related domains are likely to fail the “support” test, given the lack of centralized control over the religion.
  • “Minimising the need for defensive registrations” — A category that seems to have been specially created for .sucks.
  • “Protection of geographic names” — Most probably will be used to kill off DotConnectAfrica’s application for .africa and Patagonia Inc’s application for .patagonia. But will Amazon’s dot-brand bid also fall foul?
  • “Intellectual property rights particularly in relation to strings aimed at the distribution of music, video and other digital material” — If the GAC buys into the lobbying and believes that an unrestricted .music or .movie gTLD would increase piracy, expect objections to some of those bids. The GAC doesn’t have to provide a shred of evidence to support its Advice at first, remember, so this is not as ludicrous a possibility as it sounds.
  • “Support for applications submitted by global authorities” — This is a newly added category. If the GAC is proposing to submit advice in support of one application in a contention set, there’s no mechanism ICANN can use to ensure that he supported applicant wins the set. The Advice may turn out to be useless. Certain sports-related applications are among those with “global authority” backing.
  • “Corporate Identifier gTLDs” — Not, as this post originally speculated, dot-brands. Rather, this applies to the likes of .inc, .corp, .llc and so on.
  • “Strings that represent inherent government functions and/or activities” — Expect military-themed gTLDs such as .army and .navy to feature prominently here. Could also cover education and healthcare, depending on the government.

The GAC also plans to consider at least 20 specific applications that have been put forward as problematic by one or more governments, as follows:

Community name where the applicant does not have support from the community or the government: 1
Consumer protection: 2
Name of an Intergovernmental Organisation (IGO): 1
Protection of geographic names: 9
Religious terms: 2
Strings applied for that represent inherent government functions and/or activities: 3
Support for applications submitted by global authorities: 2

ICANN plans to formally approve the first batch of new gTLDs, with much ceremony, at an event in New York on April 23, but has said it will not approve any until it has received the GAC’s Advice.
The GAC is on the clock, in other words.
While it’s been discussing the new gTLDs on private mailing lists since last year’s Toronto meeting, it’s already missed at least self-imposed deadline. The information released today was due to be published in February.
While the ICANN Beijing meeting does not officially begin until next Monday, and the rest of the community starts its pre-meeting sessions at the weekend, the GAC starts its closed-session meetings this Thursday.

Chehade promises to cure herpes

ICANN CEO Fadi Chehade has promised to find a cure for herpes by the end of the year.
Delivering an impromptu keynote speech at the National STD Prevention Conference in Atlanta today, Chehade also apologized for the continuing existence of the pernicious viral infection, which he blamed on predecessor Rod Beckstrom.
“I came here to listen,” he told an audience of confused gynecologists. “And I’ve heard what you have said. Herpes simplex is a problem, I know this now. I’m on your side.”
“I therefore commit ICANN to curing herpes by the end of the year.”
“But we can’t do this alone,” he continued. “I therefore call on all stakeholders to work together on this important initiative.”
He added that the ICANN board of directors reserves the right to create its own cure and implement a mandatory vaccination program, should the community fail to come to agreement.
Chehade’s speech came at the tail end of a tiring outreach tour that has seen him address community members from all corners of the globe.
But reaction from the assembled physicians, epidemiologists and obstetricians was enthusiastic.
“He said everything I wanted to hear,” one beaming attendee told DI after Chehade’s 20-minute standing ovation died down. “Who knew Eugene Levy knew so much about herpesviridae?”
“I’ve no idea who that guy is,” said another delegate. “He just kinda wandered on stage and started talking. But I like him a lot.”
Herpes is an aggressive sexually transmitted viral infection, symptomized primarily by unsightly, weeping sores on the lips and genitals.
Some ICANN community members have already questioned whether finding a cure is within ICANN’s narrow technical mandate.
“This is mission-creep, pure and simple,” academic or something Milton Mueller blogged. “The cure for herpes, along with All Other Things, should be subject to free market forces.”
Mueller pointed to Chehade’s surprise appearance last week at the National Congress of Theoretical Physicists, during which he committed ICANN to preventing the heat death of the universe, as further evidence that ICANN is acting outside its remit.
Members of the domain name industry also expressed outrage.
Donuts, which has applied for .herpes, claimed Chehade’s speech threatened to interfere with its business model.
“If ICANN cures herpes, who’s going to defen… who’s going to register a .herpes domain name?” CEO Paul Stahura said.
The trademark community cautiously welcomed Chehade’s plans, but said they did not go far enough to protect rights holders.
“For too long, herpes has caused irritation for many in the IP community,” said Intellectual Property Constituency chair Kristina Rosette. “Not to mention widespread squatting problems.”
But ICANN should take care to protect the rights of HerpesTM, a popular brand of canned soup in Latin America, she added.
Meanwhile, DotConnectAfrica pointed to a throwaway line in Chehade’s speech as unambiguous proof of an illegal conspiracy against its .africa bid involving ICANN, DI, the Freemasons, the Illuminati, the Rosicrucians, the Bilderberg Group and the Ku Klux Klan.

Nutty DotConnectAfrica gives DI a good kicking

New gTLD applicant DotConnectAfrica is not happy with DI, again.
The nutty .africa applicant took issue with a recent post describing the company as “nutty” and trying to make sense of a rambling conspiracy-laden letter it had sent to the US Congress.
As a reminder, DCA is competing with South Africa’s ccTLD registry operator UniForum, which has the support of African governments and the African Union, for the .africa gTLD.
DCA has been in denial about the fact that its application is doomed for many months, scrabbling for any opportunity to cling to its .africa dream, and DI is its latest windmill.
DCA requested that I publish its lengthy “rejoinder” to our last blog post here, so I have, albeit interspersed with my own commentary.
I apologize in advance for leaving DCA’s formatting intact.

Dear Mr. Kevin Murphy,
Subject: Our Rejoinder to your article on DCA’s Complaint to U.S. Congress
The attention of DotConnectAfrica (DCA) Trust has been drawn to your recent Blog article with the title: ‘Nutty DCA Complains to US Congress about .Africa’ (http://domainincite.com/11958-nutty-dca-complains-to-us-congress-about-africa).
Even though you have continued to demonstrate your penchant for biased and negative reporting against DCA Trust, we think that the use of the pejorative ‘nutty’ is uncalled for and shows your disrespect and disdain for our organization and we believe you owe us an apology.

I don’t believe an apology is required.
DCA is the laughing stock of the industry, a status it will continue to hold until its .africa bid is killed off a few weeks from now.
“Nutty” is a generous, whimsical way to describe the company’s recent antics, which have included:

  • nuttily wasting >$185,000 on a gTLD application that has no chance of being approved,
  • nuttily applying for the wrong gTLD (.dotafrica),
  • using fake online identities to make it appear that DCA has grass-roots support for its nutty ideas,
  • throwing around nutty allegations of “wholesale illegality” without a) specifying what laws have been broken b) by whom and c) presenting any credible evidence to back up the allegations,
  • overabundant use of bold text, underlined text, colored text and font changes to distract from the fact that its nutty missives lack substance — a tactic favored by online conspiracy theorists since the dawn of the ‘net.

In short, if you think “nutty” is bad, trust me when I say it was the least antagonistic adjective I could come up with.

However, even though we already feel a sense of righteous indignation by your mocking tone and the fact that you have openly engaged in unnecessary name-calling simply to aggravate DCA Trust; we are actually more interested in setting the records straight for the benefit of your readers, and wish only to focus on the substantive issues in this rejoinder.
You cannot write to deliberately misrepresent the facts contained in our letter
to the 113th United States Congress. For example, you have stated that “according to information in Bekele’s letter, the AU wanted an experienced, Africa-based registry operator to run the TLD, and UniForum, which runs South Africa’s .za ccTLD, was the only qualified candidate.”
Wrong – Not DCA’s View to say Uniforum is Only qualified candidate
First, this is not our view, therefore you cannot put words into our mouth, and we do not agree that UniForum was the only qualified candidate to run .Africa. This is not the viewpoint conveyed in our letter to the United States Congress. We only attempted to re-state what is contained in a draft unpublished report on the ‘unofficial history’ of DotAfrica that was written by Ms. Rebecca Wanjiku, a Kenyan journalist and member of the DotAfrica Registry Project Team under the contrived ‘Africainonespace’ structure (http://www.africainonespace.org/); who had purportedly interviewed Mr. Vika Mpisane, then Chairperson of the AfTLD.

My blog post, as DCA accurately quotes, said “according to information in Bekele’s letter”. The “information in Bekele’s letter” is the text she quoted from Wanjiku’s “draft unpublished report”.
I would have cited the report itself but, as DCA says, it’s unpublished.
In a nutshell, Wanjiku reported that the AU endorsed UniForum because it “wanted African ccTLDs to play a crucial role in implementing .Africa” and that UniForum was the only African ccTLD with an EPP registry.

This interview revealed to us that no tender process actually took place, because the name of UniForum was simply put forward by the AfTLD, and this was accepted by the African Union Commission (AUC). This peculiar transaction as recorded in Rebecca Wanjiku’s account apparently contradicts the official AUC position that there was an open and transparent tender process which “attracted both local and international registries interested in managing dotAfrica gTLD.”

Only a nutty reading of the Wanjiku extract suggests that “no tender process actually took place”.
The existence of the African Union’s November 2011 .africa RFP is not open to question. It’s a matter of public record.
You can still download it here.
DCA is on record acknowledging the RFP at the time it was published, ranting: “DCA has decided not to participate in this sham RFP process and also urges prospective bidders to also avoid the RFP.”
And now DCA is openly questioning whether the tender process even happened? Nutty, nutty, nutty.

Therefore, our contention is that UniForum ZA Central Registry, the other competing applicant for .Africa gTLD is the beneficiary of wholesale illegality in the process of winning the endorsement of the African Union (AU) Commission for the .Africa geographic Top-Level Domain name. This is clearly spelt out in our letter to the U.S. Congress and it does not need any further elaboration or an extra-ordinary effort on the part of any educated person to read it several times to understand what DCA Trust is saying.

Everything DCA produces reads like it was written by Google Translate, run through an overenthusiastic thesaurus, then published by a computer science undergraduate in 1995. In my opinion.
I finished reading its letter to Congress wondering: who did the illegal stuff? What was the illegal stuff they did? What laws were broken? Where? When? Is it worth my time even asking?
Given that DCA wants Congressional intervention, one would expect it to state what the alleged illegal acts were, but it doesn’t. It just says “wholesale illegality” and leaves it at that.
It’s my view that the real reason DCA is pissed off is that, having failed to win the support of African ccTLDs, the AU’s 2011 RFP pretty much excluded DCA from getting the AU’s endorsement.
The company lacked the expertise, experience and the support of African ccTLD operators that the RFP specifically asked for and weighted in its scoring criteria.
I’m not going to pretend to be an expert in African procurement law, but I’d guess that the AU would be unlikely to publish such criteria in an open RFP document if such criteria were illegal.
That’s why, in my view, DCA throws around terms like “wholesale illegality” without getting into specifics. As soon as one look at specifics, its argument melts away like warm Nutella.
It may have been unfair, from DCA’s perspective, for the AU to require a competent partner for .africa, but if the alternative was a company that would do something nutty like, I dunno, apply for the wrong string…

Deliberately Obfuscating to confuse your readers
After reading your report, we believe that you have deliberately tried to obfuscate the matter to either confuse your readers or intentionally divert the attention of the global public from understanding the full import and main implications of our letter to the U.S. Congress. You cannot report that “the AU Commission, at the conclusion of its tender process, decided to support the UniForum proposal” when the available evidence profoundly suggests otherwise; that indeed, there was really no tender process. We have always challenged the AU Commission to publish the report of that Tender Process for the entire world to see. We also maintained this in our official response to the ICANN GAC Early Warning that was issued against our .Africa application.

DI has nothing to gain from obfuscating facts or confusing readers. The entire raison d’etre of the site is to do exactly the opposite.
The best way to avoid confusing readers would be to simply no longer report on DCA’s nutty pronouncements. Believe me, nothing would give me greater pleasure.

Only ICANN can determine a qualified candidate to operate .africa
Second, our fixed position is that only the ICANN can determine the “qualified candidate” to operate .Africa based on the outcome of the new gTLD program. This is not for the AfTLD or the AU to decide contrary to the dictates of the new gTLD program and the sacrosanct stipulations contained in the new gTLD Applicant’s Guidebook. By attempting to decide, as a fait accompli, the registry operator for the new .Africa gTLD, the AU acted ultra vires, and this is a clear usurpation, and an inexcusable violation, of ICANN’s roles, responsibilities, privileges and authority under the officially sanctioned new gTLD program. This is a viewpoint that we have already communicated officially to ICANN and also in our public comments posted against the .Africa new gTLD application submitted by UniForum ZA Central Registry.

Has DCA read the Guidebook?
ICANN makes it abundantly clear throughout that it will defer to governments on geographic gTLDs.
It won’t approve any geographic gTLDs that don’t have the support of the relevant government. For regions such as Africa, that support has to come from 60% of the region’s governments.
DCA presumably knows all this, and yet it nuttily applied for .africa (.dotafrica) without that government support, dooming its $185,000 application to certain failure.
UniForum, on the other hand, does have that governmental support, giving it a shot at being approved.
Does DCA honestly believe that ICANN’s board of directors will favor DCA over UniForum, ignoring the wishes of the governments of Algeria, Benin, Burkina Faso, Burundi, Cameroon, Cape Verde, Central African Republic, Chad, Comoros, Congo, Cote d’Ivoire, D.R.Congo, Djibouti, Egypt, Gabon Gambia, Ghana, Guinea, Kenya, Liberia, Mali, Mauritania, Mauritius, Moroco, Mozambique, Namibia, Niger, Nigeria, Senegal, Seychelles, Sierra Leone, South Africa, South Sudan, Sudan, Swaziland, Tanzania, Togo, Tunisia, Uganda, Zambia, Zimbabwe and the African Union itself?
Good luck with that.
Even if all of Uniforum’s support were to evaporate tomorrow, DCA’s application would still be rejected under ICANN’s “sacrosanct” rules, because DCA doesn’t have government support and is unlikely to get it having spent the last year randomly accusing all those concerned of corruption and law-breaking.

Third, we have always maintained that if UniForum had been endorsed to apply on behalf of the African Community, then it should have submitted an application on behalf of the African Community and acknowledged the same community in its .Africa new gTLD bid to ICANN. We believe that UniForum, after using the African Community as ‘an excuse’ to obtain an important endorsement from the AUC, deliberately failed to acknowledge the same African Community in its bid based on the answers that it provided (or failed to provide by indicating ‘blank’) to ICANN Evaluation Question Nos. 19 and 20 in its .Africa new gTLD application. In DCA’s estimation, this is deceitful and fraudulent. If you obtain an endorsement under the pretext that you intend to, or have agreed to run and operate a geographic TLD on behalf of the African Community, then you should actually apply on behalf of this named community, to wit, the African Community.
UNIFORUM Application is Not on behalf of African Community
For further emphasis, it is necessary for one to refer to the published parts of UniForum’s application and their answers to Evaluation Question Numbers 19 and 20 to indeed verify that UniForum deliberately failed to acknowledge any Community in their official answers to ICANN. In their answer to Question No. 19 (“Is the application for a Community based TLD?”), they unequivocally stated “No”. The question No. 20 (a) – (e) which immediately follows: “(a) Provide the name and full description of the community that the applicant is committing serve”; UniForum intentionally left it blank, thus indicating that they have not actually named any community that they claim to be committing to serve in their new gTLD application for .Africa.
Your redefinition of “Community” against the rule book specifications to support UNIORUM is frivolous and mischievous
Therefore, your attempt to define ‘Big-C’ and ‘small-c’ is quite irrelevant and an unnecessary exercise in frivolity at a time that analytical and professional seriousness are called for. The AU Communiqué published in March 2012 clearly states that “the AU Commission selected UniForum SA (the ZA Central Registry Operator or ZACR), to administer and operate dotAfrica gTLD on behalf of the African community”; which you also previously acknowledged in your report of July 2012. As a matter of fact, we are actually compelled to believe that your statement that “no applicant was obliged to submit a big-C Community application under ICANN’s rules” is not only flippant but also quite mischievous.

Does DCA really not understand the difference between a “community” and a “Community gTLD application”?
I’ve attempted to explain it before and I’m not sure how to better phrase it than this: one’s a type of gTLD application and the other isn’t.
I suspect DCA does “get it” because its own application for .africa (.dotafrica) states:
DCA believes that DotAfrica does not qualify as a community-based application for two main reasons:
a) There is no clearly delineated, organized and pre-existing community that is targeted by the DotAfrica gTLD.
b) It is difficult to clearly identify who are the ‘members’ of the community, since a ‘community-definition’ of DotAfrica will restrict its use and functionality. Since ‘DotAfrica’ does not necessarily mean a TLD for ‘Africans’, it is difficult to determine the persons or entities that are considered to form the community, and the number of people or entities that make up the community.

In other words, while DCA believes .africa should not be a Community application under ICANN’s rules, it also believes that UniForum had an obligation to submit a Community application anyway? Nutty.

The actual bone of contention is that an endorsement was sought and obtained under the pretext that a Community TLD application would be submitted on behalf of the African Community. The basis cannot change after one has obtained the endorsement. DCA Trust believes that it is not your responsibility to explain why UniForum willfully reneged on the commitment that was implicit in the endorsement that it had received from the African Union Commission.

Nowhere in the African Union’s RFP for .africa does it say that the applicant must submit a Community application.
I’m not aware of any statements from UniForum to the effect that it would submit a Community application.
DCA has never provided any evidence that the AU wanted a Community application nor that UniForum promised one.
Its only tenuous scrap of evidence appears to be a press release (pdf) from the AU that announces UniForum was selected to “operate dotAfrica gTLD on behalf of the African community.”
To read that sentence as “UniForum will submit a Community application” is quite, quite nutty.
Incidentally, if UniForum did lie to the AU and other governments about submitting a Community application, it’s within the governments’ power to withdraw their endorsements at any time.

Uniforum’s Endorsement should be legally invalidated
Our position is that if UniForum has reneged in its commitment, that this fundamental issue must be forced so as to hold it accountable in order to prevent the perpetration of any acts of illegality and outright fraud over the issue of .Africa; and if this is process of accountability is not established by the African Internet Community, the African Union (and its African government member states) or ICANN, then the matter should be rightfully escalated for adjudication to the powerful United States Congress as the highest over-sighting institution of the United States Federal Government. We contend that if UniForum has been fraudulent in its application, this should legally invalidate the endorsement that it has received from the African Union Commission. This determination must be made officially by some authoritative body in order for the cause of justice to be served.
United States Congress has complete jurisdiction over the entire new gTLD program by ICANN
Our understanding is that the .Africa new gTLD is an Internet resource to be delegated by ICANN, and the same ICANN is under U.S. Federal Government Oversight by virtue of its mandate as a federal contractor handling the Internet Technical Management Functions (such as domain names and unique Internet address numbering and assignment) under the IANA Contract. It is therefore our contention that the United States Congress has complete jurisdiction over the entire new gTLD program of ICANN and this cannot be challenged (or scoffed at) by anybody without drawing the ire of Congress. DCA Trust has therefore acted correctly by recognizing the overarching authority of Congress over the entire ICANN new gTLD process and deciding on its own to undertake a necessary due process escalation of this matter to Congress. It is really not our fault if Mr. Kevin Murphy as the Domainincite Blogger lacks the intellectual acuity and analytical acumen to see this matter the same way we see it.
A Dishonest Analysis: Not even ICANN will agree with your opinion – Coomunity applications are not just “a technicality.”.
Furthermore, your explanation that “there’s no need to take advantage of the mechanism if you’re applying for a geographic string and have the necessary government support” is patently dishonest. DCA’s demand for accountability is actually pivoted on this particular point: how the government support was obtained, because the ‘community’ pretext was used by UniForum to obtain the government support from the AUC. Therefore, we believe that it is not your position to justify anything or create new definitions of what ‘community’ is about. Not even ICANN will agree with your opinion that “Community applications are just a technicality of the ICANN program, designed to give advantages to applicants that truly do have the support of a community.”
Community applications are not just “a technicality”. If UniForum claims to have both community support from the African Internet Community, and the support of African Governments, and has been selected to administer and operate a geographic TLD for the benefit of the African Community (whichever way this community is defined), then why did it not acknowledge this ‘African Community’ in its application? What is UniForum afraid of? We believe that if there is a proper accountability mechanism, then the truth regarding the actual intentions of UniForum can be fully established.
DCA cannot help with your Confusion, but we do not expect Congress NOT to be confused
Again, you have attempted to obfuscate the issues by stating in your Blog that DCA seems to deliberately confuse the process AfTLD used to back UniForum and the process the AU Commission used to select UniForum. We cannot help your confusion, since if you are confused you cannot assist your readers to properly dissect and understand what the pertinent issues are.
We do not expect Congress to be confused. Our understanding is that the process which the AfTLD used to back UniForum clearly caused the ‘No Tender Process’ that was used by the AU to select UNiForum.
For us, there is no confusion since the one connected chain remains evident for anyone to see. Our letter to Congress clearly alludes to the “illegal subversion of what was supposed to be an open and competitive tender process.”
The UNIFORUm Proposal is the same as the failed ARC, which you refereed as ‘Cuckoo Business Model’
We may recall that the African Registry Consortium (ARC) that was formed by the directors of UniForum SA sometime in 2011 had tried to solicit an expression of interest from the AfTLD: “For the provision of a domain name registry solution to the African Top Level Domain Organization (aftld) for purposes of preparing, submitting, funding and promoting a successful bid to ICANN for the dotafrica new gTLD.” (See http://africanregistry.net/index.php#endorse).
The ARC proposal had failed after DCA Trust campaigned vigorously against it as a potential Black Economic Empowerment (BEE) scam and for its ‘carpetbag opportunism’. It is the same proposal of the ARC that was pushed in the name of UniForum, and as you have also acknowledged in your write-up, “the AfTLD bid morphed into the UniForum bid.” The connection is therefore quite unmistakable, and we are not fooled. DCA Trust has always warned the African Union Commission and UniForum ZA Central Registry to beware of any irregularities over .Africa new gTLD and our position has not shifted. We are fully convinced that illegality has occurred and that an accountability mechanism must be established by the United States Congress to look into this.
Your deviation from the Truth, Professionalism and Journalistic integrity
Those who have been following the Domainincite Blog (http://www.domainincite.com) may also recall that Kevin Murphy had written about the ‘Cuckoo Business Model’ which he now thinks does not (or should not) apply in the case of UniForum.

The “Cuckoo Business Model” I once discussed referred to the practice of applying for a new gTLD that you know another company is also going to apply for, not in order to actually operate it but rather to extort money from other applicants in your contention set before withdrawing.
It obviously doesn’t apply to .africa — UniForum has no intention of dropping its application and actually wants to run the .africa registry,
DCA, on the other hand, has no chance whatsoever of getting its .africa bid approved and its best-case-scenario outcome here is getting a pay-off from UniForum.
If anything, DCA would be the cuckoo.
It sucks for DCA, which was pimping the .africa brand long before UniForum, but that’s the risk it took when it broadcast its plans to the world before it knew what the rules were going to be.

Therefore, it is our opinion that you have already deviated from the path of truth, professionalism and journalistic integrity; and by engaging in unbalanced and biased reporting against DCA Trust, you have also become quite neglectful of your scared responsibilities to the global public.

As much as I hate to make ad hominem arguments, I can’t help but point out that this is coming from the company that has been creating unconvincing fake online identities to support its nutty positioning.
Truth ain’t DCA’s strong point.

Downplaying DCA’s request for US congress intervention in serious issues
Finally, we believe that you have been rather disingenuous in your attempts to down-play the reason for DCA’s request for the intervention of the U.S. Congress. We have recommended and clearly stated in our letter that Congress should:

  • appoint a new gTLD Ombudsman that would report directly to Congress
  • should give the necessary approval and official impetus for the establishment of a new gTLD Program Ombudsman that would handle and look into different forms of grievances reported by new gTLD applicants
  • and investigate any forms of alleged irregularities and acts of illegality committed by applicants, especially of the sort that DCA Trust has outlined against its direct competitor for the .Africa gTLD, UniForum ZA Central Registry.
  • the new gTLD Ombudsman will be authorized by Congress with the powers of an Independent Counsel to investigate and adjudicate on issues of illegality that have been reported regarding new gTLD matters.

This is what we are asking Congress to do, and you cannot downplay the precedence-setting significance of this recommendation by stating whimsically that ICANN already has an Ombudsman. ICANN’s Ombudsman has no mandate to investigate alleged irregularities and acts of illegality that have been committed by new gTLD applicants.

Fair point.
Asking Congress for an independent Ombudsman was quite interesting, no matter how self-serving and unjustified the request, and perhaps I should have reported the idea in a little more detail.

Nutty DCA complains to US Congress about .africa

DotConnectAfrica’s increasingly unhinged campaign for the .africa gTLD has seen it take the unusual step of complaining to the US Congress about “wholesale illegality” in the contest.
The company also appears to be running an astroturf campaign on Twitter and bogus blogs to advance its case.
In a rambling nine-page letter (pdf) to the chairs of the House and Senate telecommunications committees this week, DCA chief Sophia Bekele outlines a series of “corruption” claims against rival .africa applicant UniForum.
DCA and UniForum are both applying for .africa. UniForum, per ICANN rules, has the support of the African Union and over 60% of the national governments in Africa. DCA has no support.
As far as I can tell, DCA thinks the way the African Union went about picking a favored applicant for .africa was “corrupt” but the letter needs to be read several times in order to even begin to figure out what the allegations are.
The allegations seem to stretch back to 2011, when the AU publicly stated that it did not support DCA‘s claims to .africa, and that it had opened up an Expressions of Interest process to pick a preferred registry.
At the time, an organization called AfTLD, which represents African ccTLD operators, said it was preparing a bid for .africa. This bid later morphed into the UniForum bid.
According to information in Bekele’s letter, the AU wanted an experienced, Africa-based registry operator to run the TLD, and UniForum, which runs South Africa’s .za ccTLD, was the only qualified candidate.
DCA goes on to say that Vika Mpisane, who was both chair of AfTLD and CEO of .za policy overseer ZADNA, worked within AfTLD to have UniForum put forward as its preferred applicant for .africa.
The AU Commission, at the conclusion of its tender process, decided to support the UniForum proposal.
So what’s DCA’s beef?
Where exactly is the alleged corruption, according to DCA?
It’s almost impossible to tell from Bekele’s letter, which seems to deliberately confuse the process AfTLD used to back UniForum and the process the AU Commission used to select UniForum.
By DCA’s maddening logic, if Mpisane used his influence as chair of AfTLD to push for AfTLD to support UniForum’s bid, that means the AU Commission’s subsequent tender process was somehow corrupt.
It makes no sense to me, and I doubt it will make any sense to the dozens of US Congressmen DCA has carbon-copied on the letter.
My understanding is that DCA didn’t even bother to respond to the AU Commission’s tender anyway.
The second main prong of DCA’s new attack concerns the fact that UniForum’s bid for .africa is not a “Community” application, as defined under ICANN’s rules.
Again, DCA attempts to confuse the reader by conflating the normal everyday use of the word “community” with the special meaning of “Community” in the new gTLD program.
Bekele writes (emphasis removed):

UniForum contrived to obtain a highly valuable endorsement for a geographic name string under the pretext that it would be submitting an application on behalf of the African Community, but after obtaining the endorsement from the African Union Commission, not only failed to prepare and submit a Community TLD application for .Africa, but also failed, rather deliberately, to acknowledge the same African Community in its application that was submitted to ICANN for the .Africa gTLD name. DCA Trust believes that this was a very serious infraction on the part of UniForum ZA Central Registry.

Of course no applicant was obliged to submit a big-C Community application under ICANN’s rules, even if their gTLD purports to represent a small-c community.
Community applications are just a technicality of the ICANN program, designed to give advantages to applicants that truly do have the support of a community. There’s no need to take advantage of the mechanism if you’re applying for a geographic string and have the necessary government support.
Note also that DCA did not apply as a Community applicant either.
What does DCA want from Congress?
DCA is based in Mauritius. It appears to be complaining to the US Congress due to the US’ special oversight relationship with ICANN, and because its complaints to African governments have fallen on deaf ears.
It wants Congressional oversight of the new gTLD program, through the appointment of a special Ombudsman.
The letter says (again, emphasis removed):

We are hereby appealing directly to the United States Senate as the Upper House of the United States Congress, its Judiciary Committee, and other important Congressional committees that have a relevant stake in a successful outcome of the new gTLD process; to give the necessary approval and official impetus for the establishment of a new gTLD Program Ombudsman that would handle and look into different forms of grievances reported by new gTLD applicants; and investigate any forms of alleged irregularities and acts of illegality committed by applicants, especially of the sort that DCA Trust has outlined against its direct competitor for the .Africa gTLD, UniForum ZA Central Registry.

ICANN already has an Ombudsman, of course, Chris LaHatte. DCA complained to him late last year about two perceived conflicts of interest on the ICANN board of directors.
The complaint was dismissed last December because DCA was unable to provide LaHatte with any information about any improper actions.
LaHatte did however ask Bekele to simmer down the tone of her attacks, which she “readily agreed to”.
More fake identities?
Almost as an aside, I noticed today that a lot of similar-looking Twitter accounts (pictured) have been tweeting links with the hashtag #dotafrica this week.
The accounts all appear to have been created on Monday, using silhouette-based avatars, and have tweeted the same stuff at roughly the same time.
Is this more DCA astroturfing?
Bekele was caught out using a fake identity on the AfrICANN mailing list a few months ago.
Two of the “news blogs” these Twitter accounts have been linking to, domainingafrica.com and domainnewsafrica.com, were originally registered on November 21 2011, before disappearing behind Whois privacy last June.
The original registrant of both? Why, it’s Sophia Bekele.

Two ICANN directors update their conflicts profile after .africa complaint

ICANN directors Mike Silber and Chris Disspain have updated their official statements of interest — used to identify potential conflicts on the board — after a complaint from a .africa applicant.
The new SOI statement more clearly specifies the relationship between South African ccTLD policymaker ZADNA — for which Silber acts as treasurer — and Uniforum, which has applied for the .africa gTLD.
(December 28 Update: Silber, in the comments below, states that the update to his SOI was in no way a response to the DCA complaint.)
It also gives a bit more information about Disspain’s employer, .au policymaker AuDA, and ARI Registry Services, which is providing the back-end registry services for dozens of new gTLD applicants.
Here’s Silber’s new SOI summary, with the relevant new text highlighted:

Member of the Management Committee and Treasurer of the Internet Service Providers’ Association (ISPA) South Africa. He is also, a Director and Treasurer of the .za Domain Name Authority, the ccTLD administrator for .za. The .za Domain Name Authority has concluded an arms-length operating agreement with Uniforum t/a the .za Central Registry for Uniforum to operate the .za registry. Under the agreement, Uniforum will collect and pay transaction fees to .za Domain Name Authority. Uniforum is acting as the registry service provider for various new gTLD applicants.

Here’s Disspain’s, again with my emphasis:

Director and CEO of .au Domain Administration Limited, the .au ccTLD manager; .au has sponsorship agreement with ICANN under which .au pays ICANN a yearly amount based on the amount of names under management. Former Officer of ICANN, Paul Levins, is a Director of .au Domain Administration Limited. .au Domain Administration Limited licenses AusRegistry Pty Ltd to run the registry for the second level names in .au. Under the Registry License agreement, AusRegistry pays fees to auDA; companies affiliated with AusRegistry are affiliated with new gTLD applications.

AusRegistry is technically ARI’s parent, but they share many of the same senior executives.
The updated statement comes shortly after a complaint filed with ICANN’s Ombudsman by .africa applicant DotConnectAfrica about Silber and Disspain’s alleged conflicts of interest over the gTLD.
While the indirect connection between Silber and DCA’s rival .africa applicant Uniforum is clear, it was not obvious to Ombudsman Chris LaHatte what Disspain’s conflict was supposed to be.
LaHatte found no actions that constituted conflicts of interest from either director, but he appeared to nudge the board to providing fuller disclosure, which is what seems to have happened here.
