XYZ reveals .monster gTLD launch dates
XYZ.com has quietly unveiled its launch plan for its recently acquired gTLD, .monster.
General availability, with no eligibility requirements, is due to begin April 1.
The 30-day sunrise period is due to begin in just a couple of weeks — February 18.
.monster was acquired late last year from recruitment web site Monster.com, which had intended to operate it as a dot-brand, for an undisclosed sum.
Before the acquisition closed, Monster and ICANN amended the registry contract to cut the special dot-brand terms that would have removed the need for a sunrise period and would have prevented the domain being sold to regular registrants.
XYZ also intends to run a week-long Early Access Period — where premium prices apply — starting March 21.
I quite like the idea of .monster as an open gTLD.
While it’s certainly not going to perform as well volume-wise as .xyz, say, I can see it fitting nicely into the “quirky” niche occupied currently but the likes of Donuts’ .guru and .ninja — not really viable as standalone TLDs, but decent enough as part of a portfolio.
The company is pitching the TLD as “a domain for creative thinkers, masters of their craft, and modern-day renegades.”
New .jobs contract based on new gTLD agreement
ICANN and Employ Media are set to sign a new contract for operation of the .jobs registry which is based heavily on the Registry Agreement signed by all new gTLD registries.
.jobs was delegated in 2005 and its first 10-year RA is due for renewal in May 2015.
Because Employ Media, like all gTLD registries, has a presumption of renewal clause in its contract, ICANN has published the proposed new version of its RA for public comment.
It’s basically the new gTLD RA, albeit substantially modified to reflect the fact that .jobs is a “Sponsored TLD” — slightly different to a “Community” TLD under the current rules — and because .jobs has been around for nine years already.
That means it won’t have to sign a contract forcing it to run Sunrise or Trademark Claims periods, for example. It won’t have to come up with a Continued Operations Instrument — a financial arrangement to cover operating costs should the company go under — either.
Its commitments to its sponsor community remain, however.
ICANN said it conducted a compliance audit on Employ Media before agreeing to the renewal.
Employ Media remains the only gTLD registry to have been hit by a formal breach notice by ICANN Compliance. In 2011, it threatened to terminate its contract over a controversial proposal to all job aggregation sites to run on .jobs domains.
The registry filed an Independent Review Process complaint to challenge the ruling and ICANN eventually backed down in 2012.
The fight came about as a result of complaints from the .JOBS Charter Compliance Coalition, a group of jobs sites including Monster.com.
ICANN threatens to shut down .jobs
In an unprecedented move, ICANN has threatened to cancel a top-level domain registry operator’s contract.
Employ Media, the .jobs registry, faces losing its TLD if it does not shut down Universe.jobs, the controversial jobs board operated by its partner, the DirectEmployers Association.
In a letter to the company (pdf), ICANN general counsel John Jeffrey wrote:
By not establishing any meaningful restrictions on who may register second level registrations in the .JOBS TLD, Employ Media put in operation a TLD where anyone can register names, thus defeating the purpose for which the sponsored TLD came into existence.
…
We are calling on Employ Media to take immediate actions to implement restricted registration policies that support the purpose for which the .JOBS top-level domain was established, and to cancel registrations and/or disavow themselves of the benefits of any registrations that are owned by related parties, if any.
The move comes following a complaint filed by the so-called .JOBS Charter Compliance Coalition, made up of jobs board such as Monster.com and CollegeRecruiter.com.
They’re annoyed that the registry licensed 40,000 premium geographic and vocational .jobs domains to DirectEmployers for Universe.jobs, which has started to compete with them.
Jeffrey wrote:
It appears that Employ Media and SHRM, through the Direct Employers Association, intend to use the .JOBS TLD primarily to compete with other internet job boards. Such use is inconsistent with the purpose stated in the .JOBS Charter and represented to the ICANN community.
The deal came as a result of a change to the .jobs registry contract, made through ICANN’s Registry Services Evaluation Process, that allowed Employ Media to lift a rule that restricted registered domain names only to the names of companies.
What the RSEP didn’t do was change the .jobs Charter, which restricts “who” may register .jobs domains. Yet, weirdly, the Charter is partly the basis for ICANN’s threat.
Jeffrey refers to the Charter restrictions, which are easily circumvented, as “specious” and “do not serve the international human resource management community”.
This is the Charter that ICANN approved back in 2005, and which hasn’t changed since, remember.
To come back into compliance, ICANN wants Employ Media to shut down Universe.jobs and get back to selling company-name registrations.
I think it’s likely Employ Media will appeal, possibly by taking the case to arbitration, as its contract allows.
Sponsor stonewalls .jobs critics
The sponsor of the .jobs top-level domain appears to be giving opponents including Monster.com a hard time as they continue to challenge the liberalization of the domain.
In its most recent ICANN filing (pdf), the Society for Human Resource Management said it does not want to meet with the .JOBS Charter Compliance Coalition and ICANN to help resolve their differences.
Last week, SHRM declined to given ICANN a straight answer when it asked whether jobs sites like Monster.com will be able to register domains under the new .jobs rules.
The Coalition of jobs sites was assembled to oppose the “Phased Allocation Program”, which allows .jobs registry Employ Media to allocate thousands of premium geographic and vocational domains to its partners.
While the program has already been approved by ICANN’s board, the Coalition has filed a Reconsideration Request appeal in an attempt to get the ruling overturned.
This week, Coalition lawyer Becky Burr sent a letter (pdf) to ICANN asking for a face-to-face meeting with representatives of ICANN, the Coalition, Employ Media and SHRM.
In response, SHRM general counsel Henry Hart said the organization “does not believe that it should participate in such a meeting.”
Last week, SHRM threw its full support behind Employ Media, tersely responding (pdf) to a list of ICANN’s questions relating to the registry’s plans for the domain.
ICANN’s reconsideration committee wanted to know whether the allocation program violated the .jobs charter by allowing registrants from outside the human resources community.
SHRM said it did not, but it did confirm that it does expect .jobs – which has so far been reserved for companies to list their own job vacancies – to be used in future for aggregated jobs sites operated by Employ Media.
Did the SHRM PD Council intend to enable the Registry (Employ Media) to register domain names in the .JOBS sTLD for the purpose of allowing third-party job postings on those sites? If so, please explain how this consistent with the .JOBS Charter.
Yes. The PD Council concluded, based on input from the Community, that this would serve the needs of the international human resource management community.
But when ICANN asked whether this means Monster.com, for example, would qualify, SHRM response was more vague.
Are independent job site operators (such as Monster.com) engaged in “human resources management” for the purpose of the definition set forth in the .JOBS Charter if the job site operator is advertising for jobs outside its own organization?
Independent job site operators provide a highly valued service to the international human resource management community.
The Coalition, in Burr’s letter, said the answers “simply ignore the responses sought by the direct questions of the [Board Governance Committee”.
Hart disputed this characterization of the answers.
Employ Media plans to allocate premium domains at first via an RFP process. It’s believed that the DirectEmployers Association is set to receive the lion’s share of the good domains for its universe.jobs plan.
ICANN to reconsider .jobs auction deal
ICANN will take a second look at its decision to allow the .jobs registry to allocate premium domain names to its partners, following an outcry from jobs boards including Monster.com.
The Board Governance Committee posted a brief note yesterday confirming that it will process the Reconsideration Request filed by the .JOBS Charter Compliance Coalition a month earlier.
This does not mean that the .jobs decision will be reversed. The BGC has the power to make recommendations to the ICANN board, which the board is free to accept or reject.
The Coalition is annoyed that ICANN has given Employ Media, the .jobs registry, a carte blanche to allocate premium dictionary and geographic domain names via an RFP process.
Many expect the registry to allocate substantial chunks of real estate to the DirectEmployers Association, under previously announced plans to create a free listings site at universe.jobs.
Under ICANN bylaws, the BGC now has 90 days to reach a decision.
The deadline for submissions in response to Employ Media’s RFP is this Friday.
Monster.com slams .jobs plan
Monster.com and the US Chamber of Commerce have ripped into Employ Media’s plans to liberalize the .jobs top-level domain, with Monster calling the plan “anti-competitive”.
Both organizations have over the last two days said they support the ICANN Reconsideration Request I reported on here.
Essentially, they want ICANN’s board to reverse the decision that would allow Employ Media, the .jobs registry, to start leasing thousands of .jobs domains to whichever company offers it the best deal.
Monster said (pdf) this:
The Board has, without proper consideration and deliberation, consented to the privatization and capture of a sponsored top-level domain (“sTLD”) by a single registrant or small group of registrants.
The jobs boards market is pissed that Employ Media has already made it pretty obvious that it plans to lease thousands of premium domains to the DirectEmployers Association.
Monster claims that the ICANN decision to allow the registry to start accepting “non-company-name” registrations violates the original .JOBS Charter, which limited the registrant pool to companies that wanted to advertise their own vacancies at “company.jobs” URLs.
The company says that the move could create “serious consequences for ICANN’s credibility” as it rolls out new TLDs, on the basis that it sets a bad precedent for ostensibly restricted “community” TLDs:
ICANN will be viewed as willing to tolerate sweeping, unauthorized changes to community based TLDs with no regard for the representations made during the application process.
Monster also says that the board’s decision “has broad anti-competitive implications that were not examined by staff”.
The US Chamber of Commerce, which has previously opposed TLD expansion in principle, has also chipped in (pdf) with its opposition, echoing Monster’s thoughts and adding that the proposed .jobs expansion fails to protect IP rights.
